PR expring May 2017, need to travel and enter before expiry

dpenabill, naheulbeuck and Leon - I have a situation: As of this writing I have completed 600 days in Canada, I have entered Canada on 27 March 2012 on Immigration and lived 27 days and went back, AND in 2013 I lived 182 days, 2014 one month and 10 months in 2015 and around 3 months in 2016. My PR is valid till end of May 2017. Currently I am in Canada to complete residency requirement but due to a family emergency (wife's prolong sickness) I want to travel back home and come back in Apr/May 2017 either direct to Canadian airport or via US border by private car. Can I take a chance now or wait till Mar 2017 and submit application for PR card renewal and travel. Your expert advice will be highly appreciated. Thanks

Having a valid PR card is irrelevant to determining if you meet the residency obligation or not. The only thing that matters around meeting the RO, is if on the day you attempt entry into Canada you have the required 2 years in the previous 5, counted from that date.

One can have a valid PR card not expiring for many years, but if they don't meet RO on the specific date they enter Canada they can be reported and have PR status revoked. If reported, you can choose to appeal but no guarantee of success.

Having a valid PR card just makes it easier to travel to Canada since you can do so with a direct flight and not have to go through PR TD or US border options, and CBSA maybe will be easier in investigation on if you meet RO or not.

Hi Rob

I am a PR.My PR is expieing On Jan17 2017.I was referring to your note on the RO in this message.I am in the same situation only difference is that i am living with my wife who is a Canadian Citizen.As a PR i have exeded the 3 years out of Canada.I am returning to Canada this November 2016.

will i have an issue with to prove my RO at the entry.My wife and kids who is also Canadaisn citizens will be travelling together with me.

Do i need to show proof of my RO at the entry?..if yes

what are some of the proofs that i need to show other than marriage certificate and wife wife's citizenship card.

Appreciate your assistance on this very much.

Most likely that is fine, but to be safe you can also bring proofs that you were living together all this time i.e. joint lease agreement, joint accounts, mail delivered to same address, etc etc.
