Dear All,

, hopefully you can help me in my situtation . I have been out of Canada for about last 3 years since my landing in 2013, we spent only one week in Montreal. Currently, I am working in UAE, Dubai, I have three kids, and two of them were landed with me in 2013. The smallest one was born in august 2014. I have got him a Travel Visa document to enter to Canada which will mainly expire in March 2018.


Since that day, we have done the proper planning to integrate smoothly with the Canadian community. Such as register my kids in French school, and their French language now is perfect.


I could not meet the residency requirements as I tried my best to contact the employers there in Montreal to get a job, but I could not get any opportunity, especially the living cost there is very expensive. In addition I am the only supporter for my father and mother, especially their age is 68, and every time, I am thinking to leave them, I think twice about my immigration. I hope you understand my humanitarian concerns.

I will be very thankful if you can help me to clarify the following questions:


1- If I decide to go next year in June 2018, Will they allow me enters, into the Canada if only one year and couple of months left for PR card to be expired? some of my family members their prc will be expire in Sep 2018 and some of them july 2018


2- If they suspect in point (1), that I don’t meet the residence requirements, which will happens, especially my son has only visa ??what will happen in this case?


3- In case point (1), they will allow me to enter, can I live with an expire PRC? Can I


Sponsor my small child in this case? will i recieve any financial assisstance for my kids who have the PRC??


4- In case (3), after completing the 730 days; will I be subject to question about my absence by the officials, on applying for renewal? Also can I apply for a job there even if my PRC is expired?


5- If in the second point applies, and they reported me as I did not t meet the residency requirements, and ask me to appeal to keep my PRC? What will happen if I appeal? Do I have to leave the Canada in this case? Can i ask for legal help help there , and keep a lawyer to be my first line of contact with immigration department there?


6- What will happen with my small child with Visa? Can I sponsor him once I reached there? In case they reported me and have to appeal?? What will happen with my small child? What do you advice?


7- Is there any way to get the residence or extend the residence five years more in Montreal, without staying the 730 days?


For now these are my questions, I will be very happy if you can analyze my situation and help me guys .

Dear jafar,

I read somewhere that the CIC may extend the PR visa under compelling personal circumstances even if the previous residency terms were not fulfilled. You will have to contact a respectable immigration lawyer and enquire about possible options. Alternatively you can apply for PR afresh which is painstakingly difficult. All the best.

PR expiry question

Dear Sir

I am going to ask about the possibility to get student visa for my daughter in Bachelor level of university in Canada and also a question about the extension of my PR card.

I live in IRAN and I got my PR card (Skilled worker category ) in November 2013 and just came to Canada for a short period to get that card and then came back to my country ,IRAN . Since I got divorced and I have a daughter who is 20 years old now that is living with me and she is a student in Third year of university in IRAN,Now.

Now, I decided to come back to Canada , since I should stay 2 years between 5 years to be able to extend The card after 5 years .The first question is that I want to know if I come to Canada in March 2017 and stay there , because I will have 4 months delay (according to my deadline to be there for 2 years between 5 years period) , does It make problem for me after 5 years when I want to extend my PR card again? The expiration date for my PR card is in November 2018.
As I am going to open Canada student Visa file for my daughter during this time In Iran and I have to stay In Iran to start this file for her and then I can come back to Canada 4 months later(according to necessary period time between 5 years to extend the PR card later) .

The second question is that I want to know If my daughter can receive Student Visa in Bachelor level in Canada ,since I have PR card and will be a residence there . I am not sure Whether it makes Positive Point for her student visa file or Negative point .


I will be so grateful I f you can advise me about these questions .

YOu need to complete to 730 days (2 years ) within 5 years of your landing.. Any few days over will end up on non-renewal of your PR card. If you days gets over, then should not leave canada until you complete your 4 years to get passport.

You being a PR holder, and tryong to get your daughter student visa ( I assume she is not PR holder) all depends on your financial income & capability to support your offspring

Thanks for response, just another question .

you mentioned that "If you days gets over, then should not leave canada until you complete your 4 years to get passport" , does it mean that It is possible to come there a bit later (according to my deadline, after the expiration of my PR card ,let's say ,4 months less than 2 years) and decide to stay there forever and do'nt leave Canada anytime, after 4 years I can renew my PR card or apply for citizenship?

About my Daughter , yes , she does not have PR card and I am worry as I've heard that It is possible the embassy does not give her student visa( because I am living there ) .I mean that some lawyers told me this is risky , because I have PR card, they do'nt issue student visa in Bachelor level of university for her(possible) .

Please advise.

If you mean... you want to enter Canada 3 years+ 4 month then its risky & as I said earlier you MAY get reported to CIC.

Chances of her visa refusal are great if you are not economically active in Canada. Even if you are active then you must be able to show sufficient funds for her education.
