PR expiring in June 2018 to land in Jan 2017. Need expert advise please

Hi,

I got PR as principal applicant in 2013 and it is expiring in June 2018. Since then, I could stay only for 4 months in Canada. Since I have only 1.5 years left for the PR to expire without meeting the obligations, I am really worried and do not want to let it go.. If I plan to come to Canada in January 2017 then would I be sent out in June 2018 because I would not have fulfilled the required time period? I am worried because I would get my son aged 13 with me to Canada and if I face any problems for PR at that time, it will affect his studies and future. Please advise.

If you come in Jan 2017 and continue to stay up to 2 years, there is chance for you to get this status kept. But you should not leave Canada for 2 years ideally until Jan 2019. I do not think you will be sent back in June 2018.

Thank you for the response. Please also tell me- how the period of 5 years is calculated.. is it from the date of original PR or any five years? Because after staying till Jan 2019, I am afraid they say the five years for me is during 2013-18 and not eligible for extension.. Please clarify..

The calculation is from the date you have submitted for the PR card. Each time is always, five years from the date today. Just make sure you only apply for PR extension after you have completed 2 years in the country in the past 5 years. Good luck.

Correct me if I am wrong but assuming the OP enters country again January 2017 then they should not leave the country again until January 2019 and only then apply for a new PR card as then they can demonstrate they were in the country for the preceding 2 out of 5. Think of the 5 years as a rolling 5 years back from todays date where need to spend 2 years minimum out of the preceding 5 in the country or looking the other way can spend maximum 3 years of preceding 5 out of the country.

The 2013-2018 will not be relevant for this purpose other than a possibility of being reported when entering in January 2017 for not meeting RO and whilst nobody on this forum can second guess that, it seems unlikely given your PR card at that time will still be in status for another 15/16 months. There are people around who have failed RO by a greater amount than the OP who will likely get a lot more focus especially those with expired PR cards coming back into the country.

If an emergency comes up and you leave Canada, then most likely upon trying to return you will be found out you're violating the RO and your PR status will be revoked. It doesn't matter what the reason is.

Also note that upon entering Canada in Jan 2017, if CBSA officer notices your RO violation you can be reported and start process to revoke your PR status.

My wallet was stolen and it had my PR Card in it.

Applied for a Replacement - 12th September 2016
AOR - 28th September 2016
In Processing - 29th September 2016

I had also attached copy of police report, COPR and my stolen PR Card.

I am travelling to India in January and my tickets were booked way before the card got stolen.

Will I be able to get it before that (cause I 've heard that there is no processing of applications in December) or should I contact CIC regarding this to process my application faster?

And also I read in someone comments that Replacement of stolen or lost PR cards is little faster than renewal. IS it true?

Processing time is around 57 days approx. CIC is working on applications since August 10th 2016. You should expect the PR card between next 1-2 months approx.

Please also advise me : Our passports are expiring in September 2018. How can I renew them from Canada? If I submit them for renewal in our country's embassy there, what are the chances that they get renewed or rejected given that the PRs expire in June 2018? Please suggest.

In order to have spent 2 years in Canada in a 5 year period, you can't spend more than 3 years outside. If you spend less than 3 years outside, you can use the first 4 months in order to meet the RO sooner so after 20 months instead of 24.

However if you have more than 1094 days outside Canada, you can not use the first 4 months because before you are able to spend the additional 20 months, your 4 months are already disappearing out the window of the past 5 years.

Your home country embassy and passport has nothing to do with immigration Canada. I have renewed my home country passport at my home country embassy and I was never asked about my status in Canada.

Hi Leon, please tell me- can we leave Canada after completing two full years there? Say in Jan 2019? Or do we have to wait till we get the PR renewed and card is received? Also advise us how to deal with any emergency during June 2018 to Jan 2019 such as any emergency for own family members in our home country when we want to travel for a short time at least..
