We completed our landing procedures way back in sept 2008. and had to return back to dubai.
Since then we hav not entered canada due to unavoidable circumstances.
we got our PR , SIN, and health cards
Now we are ready to immigrated back to canada once and for all.

Can anyone tell us what is the procedure and how long it takes.
 
I have this horrible feeling that you will have to start all over again from the beginning.
You don't seem to have met the residency obligations if you have been out of Canada for the last 5 years.

Unless someone knows of a loophole, I think you are "dead in the water".

You can try applying for a travel document on a humanitarian and compassionate basis and explain why you were unable to meet the residency obligation. If the travel document is refused, then your PR status is gone and you will have to apply for PR again from the start (if you still qualify to apply).

What were your reasons for being unable to return to Canada sooner?
 
My son had to undergo series of surgeries. Which kept us
Busy with resources crumbling. Took us last 3 yrs to get to better position

Medical reasons are often taken into consideration for H&C applications. Financial issues are not. I would document your son's medical issues in detail and include proof (doctors letters, hospitalization records, etc.) with the H&C application. If your son's medical issues prevented you from moving to Canada (i.e. he was too ill to move and you had to stay with him) - then I would say there's a chance the travel document will be approved. If financial issues prevented you from moving to Canada - then there is a higher chance the travel document will be refused and you will lose you PR status permanently.

Who do i approach the local Canadian embassy in UAEi? any applications? Do I have to pay the taxes for the time
i completed the landings from sept 2008 and how much of it.

You don't have to pay taxes since you were not living in Canada. Use the application for a travel document and write a cover letter stating why you could not meet the residency requirements and send some proof of that as well.

HI , its true that you have not meet the residency obligation, since you pr is still valid you can travel to canada and the immigration will not be able to stop you entering canada, but they will certainly enquire why you have not meet the residency and if you did not have supported proof for that, then you could be deported.
 
Yes, this method is also possible. If your PR cards are not yet expired, you could take your chances and travel to Canada. If they decide to report you for not meeting the residency requirements, they will let you enter but you will have to appeal for your status and if you fail to convince immigration that you had good reasons, you will lose your PR.

However, if you are allowed to enter Canada without being reported for not meeting the residency requirements, you could stay for 2 years straight at which time you will meet the residency requirements again and could apply to renew your PR cards in a normal way without proving anything.

If you are not sure that your reasons for staying outside Canada will be accepted by immigration, the method above is better because there is a possibility that you are allowed to enter without having to prove your reasons. If you do end up being reported and have to appeal, you would be in the same situation as if you had applied for a travel document in the first place.
