Hi,

I wonder if anyone can help.

My wife, daughter & I took up residency in Canada in 2005 and spent just under 2 years there. However at end of '06 we returned to UK where we have stayed up until the present day.

Since then I have returned to Canada each year for varying periods between a couple of weeks and 6 months and as a result have sufficient days residing in Canada to qualify in renewing my residence card. However my wife and Daughter although also both having residence cards do not meet the number of resident days requirement.

Presently, I am back in the UK with my family and because my permanent residence card will expire in May I want to try and renew it. I am about to send off my application but I am concerned that whilst I meet the residency requirements in terms of days residing in Canada I am not currently present in the country when applying, although I plan to return in summer and when required to do so to collect my new card, does anyone know whether I have a problem in submitting my application from overseas?

My parents live in Canada, hence why we want to renew my card and keep our options open for a few more years before deciding whether to return and settle in Canada and renewing the residence card for another 5 years would allow us time to make this decision.

Thank you very much for any advice anyone can lend,

Regards

John

You can not renew your residence card if you are not in Canada. You can see this at http://www.cic.gc.ca/english/information/applications/guides/5445E2.asp

To be eligible for a PR Card, you must:

be a permanent resident of Canada
be physically present in Canada
not be under an effective removal order
not be a Canadian citizen or a registered Indian under the Indian Act and
not be convicted of an offense related to the misuse of a PR card
