PR card was issued in 2008 and was expired in 2013 and we live only for 270 days & do not meet the residency requirement.
In our last visit in 2013 june we have planned to live over there for renewal of our PR card but unfortunately due to some problems in our home country we have to leave in august 2013.
We dont know about our PR status at that time.Now we are again willing to go back,is it possible we apply for travel document and go back to canada.
We got our driving licenece G1 and also admitted our childs in school.
We are waiting for your positive reply.

I'm sorry but you are unlikely to receive any positive reply. Your application for a PRTD will cause your failure to meet the residency obligation requirements to be identified. It is highly likely that it will be denied unless you can prove some H&C reasons for your absence from Canada.

CIC give PRs information on the Residence Obligation to include the carrier letter for your PR Card. In addition claiming ignorance of the law doesn't work so going with this angle won't get you anywhere. What are these 'problems' in your home country? Their nature may be considered H&C grounds for TD application and/ or PR Card renewal.

If you citizenship allows you to travel visitor visa free to Canada then fly back and deal with CBSA at the border they may let you in without report. If you require a visitor visa but have a US visa then enter via US/ Canada land border again hoping the CBSA agent lets it slide. If you get into Canada without report then sit tight for 730 days to get your PR back in good standing. If none of the travel options apply to you then apply for a TD with success subject to H&c grounds. These must be of a compelling nature e.g. bereavement, serious medical conditions etc...working doesn't cut it.

While applying TD the canadian embassy main requirement is submission of application along with all other previous original passports and PR cards (expired).If our application will be refused could they return us our original PR cards or not.So that we may arrange our entry through US border.
Is there is any chance of rejection of our entry into Canada from US by CBSA.

I don't think you get your PR cards back, or even if you do, it will not help you. What they will do, I think, is to offer you a single entry visa to allow you to attend an appeal in Canada because you have physically been in the country within the last year. However, once under appeal, any further time you spend in Canada is NOT counted towards residency unless you win the appeal.

Once the PRTD has been applied for, it's out of your hands and there is nothing that you can do apart from win the appeal. Nothing else will allow you to re-establish your PR status. It is very obvious that you made no attempt to meet the residency requirements in your first five years and it's only because events have conspired against you that you have now fallen into the trap. I just hope that the "some problems in our home country" were worth losing your PR status over.

As a PR, you cannot apply for any sort of visa. They will reject it automatically.

Do you have to show them the expired pr card? Or you just show the visa exempt to enter Canada? Wouldn't they know that you are a pr when they scan you visa?

There is no "best" option. You can try and sneak across the US/Canada border, if you can get to the USA.
As far as I can tell, you are not visa-exempt, so in fact, that is your only option apart from applying for a PRTD.

No they don't return the PR Cards back to you. Legally the cards are not your personal property so you can't for example sell them or use them as collateral against debt. You need to understand that once you apply for a TD there isn't a 'oh we don't qualify give us the cards back and we'll try a different route' option. It will help you understand that there are 2 issues PRs who don't meet the RO (so should not apply for a TD unless H&C grounds) as in your situation face:

1. Getting to the border

2. Once at the border getting admission into Canada without being reported.

Visitor visa exempt nationals and/or those with a US visa can get to the border. Everyone regardless of how they got to the border has a risk of being reported...it depends on your luck on the day.

You need to deal with 1 first before you even think about 2!
