PR card Expired,How to enter Canada and unite with family

Hi All
My daughter PR card expired in 2015 as she was pursuing 6 yrs professional course in India. Would like to know How can she move to Canada now to meet her family who are in Canada and secondly How can she maintain her PR status in spite of not meeting Residency obligation(as was in India and enrolled in study). Kindly advice. Thanks.

With difficulty. She either needs a PR Travel Document, which may well be refused and her PR revocation commencing, OR cross the land border of the USA into Canada and hope she doesn't get reported. There are no other alternatives. Study choices may well not be considered as a good reason to not comply with the residency obligation requirements.

To renew, she would need to live physically in Canada for long enough to be back in compliance with the residency obligation requirements of 730 days before she can renew. She should be able to continue education in Canada but they may charge international student fees. Health card and driving licence will depend on the province and what documents they will accept.

If she loses her PR status, she will have to start all over again from the beginning. If she is below the dependant child cutoff age, she could be sponsored, assuming that the sponsor is eligible. Apart from that, only an acceptable H&C assessment would allow her to keep PR status if reported.

I read that as the OP implied a masters course was a possibly that the daughter is no longer of dependent age (under 19) so her only real chance is the land border given study outside Canada and not meeting the RO is not a valid reason. If she makes it back in she will of course need to stay in country for 2 years to reset residency and in that time possibly not advisable to try renewing PR card as that may highlight failure to meet residency in any case.

OP's first post in 2012 indicated daughter was 11 at that time, making her approx 16 now. Not sure what a "professional course" means, but maybe this was just high school.

If daughter is still under dependent age, then she should try to apply for PR TD under H&C grounds for not meeting RO. I'm not sure how this will work for a minor not living in Canada, but parents are in Canada.

If PR TD is approved, she can return to Canada and immediately apply to renew PR card.
If PR TD is rejected, she should just accept revoking of PR and parents can apply to sponsor her with new family class application.

If daughter is really well over age of dependent, that's a lot tougher. OP will need to confirm this.

Younger daughter was 11. The daughter he is speaking of was 17 when they became PRs in 2010, so she is now well beyond the age where an H&C PRTD app would work.

If she gets into Canada without being reported, she can't apply to renew her PR card for 2 years. Many, if not most, universities require valid proof of PR status, so she may well face difficulties being accepted as a domestic student. Same goes for a health card and DL, depending on the province.

Also, if she never obtained a SIN when she first landed, she will not be able to get one until she once again has a valid PR card. Service Canada doesn't accept COPRs more than a year old or expired PR cards. This means she would not be able to work during those 2 years.

If she surrenders her PR, at her age, there is little chance that she would have the necessary work experience to qualify to immigrate independently. She would need to look into the different economic immigration apps to find out.

Your daughter is no longer considered a dependent.

Many Thanks for all the replies. She is dependent financially . Our biggest worry is how to bring her to Canada now.She was doing Medicine in India.I feel I have to choose one of the few options,but which is best donot know. or may be other options?
1. surrender PR and apply tourist visa and once in Canada join a masters course and while studying as international applicant apply for new PR?
2.Apply for Masters course from India and get work visa/study permit and move to canada and apply PR while studying.
3. Enter via US and if lucky and not reported, stay 2yr(and join masters course-not sure if possible on expired PR) and renew PR.

You can't realistically qualify for PR as a student. It would have to be via one of the available economic streams available at the time, after completing study AND gaining Canadian work experience. Qualifying would be non-trivial. You seem confused about exactly what is available / permitted. I recommend that you study the current immigration options in detail to gain clarity.

Option 3 is the most realistic.
