Hello forum members,

I am seeking for your opinions, experience and advice.

I have a doubt regarding the information in the reference letter for the main and only NOC (4211 trademark agent) based on which I applied for PR. My story is the following.

When I have received the long-awaited nomination from Ontario, I immediately got ITA. So I applied for PR based on updated reference letter with the same content which was in the Reference Letter at the provincial stage but issued at the later date. The problem is that officially I am employed as "Foreign Economic activity manager" (the occupation in my 1st Masters diploma, in which I have never worked). This occupation/profession has nothing to do with my actual duities and responsibilities which correspond to NOC 4211 (trademark agent). In fact the whole company's sphere of activity is Intellectual Property worldwide protection including trademark filing and prosecution. So basically I am working as a trademark agent but my official title which is used only for the company's internal records sounds like "Foreign economic activity manager". Everywhere in business correspondence my position is indicated literally as a "trademark agent", although there is no such an occupation in national occuational classificator in my country, the closest one to trademark agent sounds more general, like "specialist in the sphere of intellectual property".

So in order avoid confusion of my PR application examiner by this mismatch between my formal title and actual duties I decided not to include my formal title in the reference letter (the only thing i regret that i did not explain this in the Letter of Explanation). The reference letter was provided in English, sealed by the company stamp, signed by one of the company owners stating that I have been working in the company "as a trademark agent". So my concern is the following - in case the officer processing my PR application finds out somehow that there is no such an occupation in my country occupational list and will decide to check over the company's phone what my official occupation in the company sounds like, will this entail problems/rejection for me provided that I instructed the secretaries and other potential contact persons of the company on how to explain everything (like my actual duties and my occupational title do not coincide, and i work as a trademark agent in a trademark department, etc.)? What do you think guys, should I raise a CSE?

Job titles are completely irrelevant, what's important is that your NOC matches your duties and responsibilities.

Thank you DelPiero,

My duties definitely match with NOC 4211 description for about 85 % out of 100. I even consulted with the NOC team regarding my code.
