The ministerial instructions may soon change when they have reached their ideal no. of immigrants for the 38 occupations. They cannot flood their country with majority of immigrants having the same occupation. Soon, they may change the list and those who were not so lucky before may re-apply again.

Nothing is permanent...except maybe for the permanent resident visa :)

Hi all,

My application status:
Sent application to Sydney NS: 26th April 2009
Received AOR/recommendation from Sydney: 02 June 2009

Now i am facing great trouble. I can't send full application to islamabad since i have not taken IELTS and French exams yet and on my inquiry French Alliance told me that it would take a year to pass Basic french level 1 to 3 and later needed to appear in TEF exam too. I have only 120 days and it seems to me better if i withdrawl my case and apply again.

Any sugguestions? I am afraid in near future they would change 38 occupations. And without French i can't qualify for 67 points. What should i do now? How long would it take to get my fees back? and how to say to them return my fees? I have sent them email but they are not replying.

Dear BakuSalman;

I am sorry to know about your situation. I suppose that you have to wait. You must prepare yourself at least for one year for French Language course if you do not apply for Quebec. But this is just my personal opinion. So, please make more inquiries...

Good-luck!

Hi BakuSalman,

Could you not ask your sister who lives in Edmonton to sponsor you through the Alberta Provincial Nominee Program?

http://www.albertacanada.com/immigration/immigrate/familystream.html

See if you qualify.

Good luck to you!

Hi again, does the program not require availability of funds from EITHER candidate or sponsor? I think your earlier post says that you have Can$12,000?
I read through the requirements and it says ---

The Sponsor must be able to demonstrate employment, private pension or other regular source of income for the past 12 months OR a minimum of CAD $15,000 in unencumbered, transferable and available assets (jewellery, cars or other personal assets are not considered) over and above any income received from government transfer payments (e.g. Old Age Security, Canada Pension Plan, etc.).

Read through the program some more, you might find something that could work for you.

could you give the money (that was meant for FSW visa) to her and then she sponsors you. Would that be considered illegal?
There might be tax implication.

She could sponsor me if she had $15,000 in cash or working somewhere. She is housewife and does not have $15,000
And it is not possible for me to give her $15,000 since i have to show $10,000 for myself.

And i talked to many people they say if i have any of the following case then i can get 22 points otherwise not.

Obtained a three-year diploma, trade certificate or apprenticeship (other than university) and completed at least 15 years of full-time or full-time equivalent studies

Obtained two or more university degrees at the bachelor's level and completed at least 15 years of full-time or full-time equivalent studies

So please make sure 16 years of total education gives me 22 points or not?

Because CIC website says if i Obtained a university degree of two years or more ( i have 4 years degree )at the bachelor's level and completed at least 14 years of full-time or full-time equivalent studies then i can claim only 20 points.

I am confuse.

If my degree matter solves then i just need to pass IELTS with 7 band and i can qualify for immigration.

Please advice me in this regard. I am afraid i can't obtain 7 bands in IELTS...Lack of Confidence

If you have only one bachelors degree and say 16 years of education, you get 20 points.
If you have two one bachelors degree and say 16 years of education, you get 22points.
If you have 3 year diploma and say 16 years of education, you get 22 points.

Thats what i think anyway.

Get a couple of more years working experience, continue your french studies and apply again in a couple of years. Just make sure you take the IELTS and TEF before you apply so you know for sure you have 67 points. As for a change in occupation list, nobody knows. You just have to hope for the best.

Hi experts!

Like the original poster, I am an IT professional - a software developer (I believe the Canadians call us software engineers!) :)

I have a computing bachelor's degree and 11 years industry experience as a professional developer, currently using C#, as well as several Microsoft developer certifications. My wife has a doctorate in Chemistry and currently works as a research scientist.

We each comfortably have more than the required 67 points.

Earlier this year we both looked at the possibility of moving to Canada (Vancouver ideally), only to be told at an immigration fayre that since our professions didn't quite fit in the 38 occupations (I don't have management experience and my wife doesn't have enough teaching experience to fit) we would be unable to apply as federal skilled workers.

I do have an elderly great uncle living in Vancouver but he's a bit old for reliably asking to sponsor us under a family visa. My wife has a cousin in New Bromswick but apparently cousins are ineligible for sponsorship for family visas.

So a little frustrating! :)

So currently our best option will be to save up money and just go for a long holiday and hope to strike lucky once we are over there by one of us finding a job with a work permit so we can apply for our permanent residents visa once over there.

Although we'd like to settle around Vancouver, we are considering perhaps moving to Calgary/Alberta initially where there are possibly more IT jobs.

Would be very interested to know if there's any formal review date of the current list of 38 occupations. I feel my wife and I have a lot of experience, skills and qualifications we could offer Canada, so are presently intending to watch the 38 occupation list closely.

Best wishes.

As far as I know, there is no plans for review of the list soon. Where are you? If you are on H1b in the US, you could look at Alberta's program. If you know french, then you could look at Quebec's immigration program.

BTW is your wife a research scientist in a company or like a research professor at a university?

Hi thanks for the reply.

We live in the UK. My wife works for 3M (big global company). There is a 3M in Calagary so an internal transfer is an outside possibility, depends what research facilities and vacancies they have there.
