Posibility of approval of Application for Express Entry

We are to apply for an Express Entry this year, I am a Quantity Surveyor working in Dubai for almost 5 years and my husband is working in Canada under Open Work Permit. Unfortunately his work permit has expired last Nov 2017 as we are still on the process of applying for our Permanent Residency then.

Our application was rejected due to his failure to submit his T4 from his first employer. It was found out that the agency that he was working for at that time is not paying his tax.

We tried to reapply for our PR last February 2018 informing CIC the circumstances, unfortunately it was rejected again.

The new agency that is handling our application advised us to apply for an express entry, however my concern is the following:
1. Will our application be affected if he is still staying in canada without work permit.
2. Does he need to go out of canada before we submit our application?
3. Until when can he stay in canada without work perit?

What is your husband's status in Canada now? Did he apply to change his status to visitor before his work permit expired last year? He can be in Canada without a work permit. However he must have valid status in Canada to apply for PR. He cannot be out of status in Canada.

no status as of the moment. He did not apply for visitor or extension as we are waiting for the result from our PR application. When the PR results came it was rejected, then his agency again re-applied again last feb 2018 however we got the response from immig that it was rejected just this May 2018.The application is work permit and PR.

So now the agency is advising us to apply for Express entry, me as the principal applicant however I am doubtful that we will be approved because of my husband's current status in canada.
