Hi all

My spouse who is the Principal Applicant is from Macedonia, (I am the sponsor Canadian citizen) and she has lived with me in Greece as a non resident just by using the visitor status which meant that she exited the country every week (only 78 km from our residence) visited her family on the weekends and returned home.
This is being going on now for the past 4 years. (She could not become resident in Greece due to her country not being in the EU)
My question here to anyone who might know the subject!
She will get a police certificate from her country but she cannot apply for one here in Greece because she is a visitor and according to Greek law visitors cannot apply for Police certificates.
What do we do in this case?
Would the one PC from her country is enough or CIC would ask for one from Greece also because this where she stayed more than 6 months!

I will appreciate any input in this

Hey Messenger,

it is a very very tricky situation indeed, as probably CIC will ask for a certificate for Greece. I don't have any experience with this specific type of experience, but in my case (I'm the applicant) I could not provide one specific certificate (could not go back to the country, POlice check could not be issued form outside etc). So what I did: I tried "every way possible", and documented everything I did (printed emails from different contacts saying that they tried on my behalf etc), all the steps I took to get the certificates ( it went on for more than 7 months), and I failed to get it : I then sent a letter to my VO, to add to my application, explaining what I had done, and asking them for lenience about that case... and it seemed to have worked, because I got "decision made" a few weeks ago ( sitll waiting for the actual document to arrive in Canada, but well - it should get here soon!).
So if nobody else comes with another solution, I would try something similar in your case. get official proofs that as from outside of EU she can not get a residence permit. If possible, get proofs that she has been travelling back and forth. If she was working, or related in any sort of way to anybody official, get them to write a letter that to the best of their knowledge, this person has not committed any crime ( I got a similar letter from my employer at that time and it probably help).
If possible, explain your case as best as you can, also explaining that your wife has legally being admitted into Greece everytime, which would not have been possible if she had committed any crime in Greece. Etc!

Prepare well, give all the proofs of the situation, make sure that she has the Police Check from Macedonia, and write a "nice letter" to the VO to explain - then hope for the best! it might delay a little your application, but you can hope that they will not ask for the visa and they will understand how it works...

Hey Sweden, Thank you very much for the very descriptive answer

The only crime committed was falling in love :D lol
Other than that I will try to get her some sort of police certificate that will probably show that at least she did not brak any immigration laws of the country. We do have the entry and exit sheets with stamps from the border control.
