Police checks

Good evening,

I'm in the process of completing my inland spousal application. I just realized that the police checks I have are older than the requirements. I have my Australian police checks dated January this year and FBI check dated May this year. I plan on sending in my application with these police checks and adding a note saying I will provide updated police checks as soon as possible (I have already sent off my FBI check) and that I haven't left canada since I sent off the requests for the checks. I have a couple of questions:

1. On the document checklist should I tick the box saying I have attached the police checks even though the ones I will be submitting are out of date?
2. Is there a chance that this could prevent me from getting my OWP that I will submit with my inland application?

My current work visa expires in December and I'm worried about losing my status

They're good for 6 months, not 3 months now (though the inland guide still says 3 months for some reason). However, your Australian one would still be over the time limit. How long does it take to get the Aussie check done? If it's possible to get that one before your USA check expires you will be ok.

Hi Aquakitty - Can you please tell me where you found the information that the FBI police checks are now good for 6 months. I just looked and for the outland application guide it still says 3 months). I'm asking because we inadvertently forgot to include the document checklist when we mailed our application to CIC last week and I'm assuming they will mail it back to us to correct the problem. My police check expires 9/22/15 if we go by the 3 month expiration. I'm hopeful they will just email us and ask us to send in the document check list instead of returning the whole application back to us. Just trying to figure out if I need to redo the fingerprint FBI background check again should they return the application back to us in the next month because as you know, it will take about 3 months to get it back from the FBI. Thanks!

I got my Australian police check within 2 weeks of ordering, they usually send them out pretty quickly.

Don't forget if you lived in VIC or QLD that you need the driver history as well :)

Thanks guys!

I spoke to the CIC call centre last week about my FBI check, they said that iI should get it redone as its over 3 months from the date on the FBI check. I have sent off my fingerprints to the FBI, I hope to get the results early December.

I could request a new Australia check and new drivers history, but I want to send off my application ASAP as my current work permit expires in December and I want to get implied status while I wait for my OWP.

I will write a cover letter explaining i have expired police checks (I will send in the originals of the police checks) and mention that I will submit the checks as soon as I receive them. Do you think that could jeopardise my OWP application?

I know, all I know is, this is what it says on the website now:

Who needs a police certificate?
In general, you and all the people in your family who are 18 or older need to get a police certificate. You must get one from each country or territory where you have lived for six or more months in a row since the age of 18. (For example, if you lived in a country for eight months but left on a two-week vacation, that counts as living there for eight months.)

For the country you currently live in, the police certificate must be issued no more than six months before you apply.

For countries where you have lived for six months or more, the police certificate must be issued after the last time you lived in that country.

Pretty vague, but this used to say 3 months, now it says 6. The last time I said 3 months, I was corrected on here by someone that it is 6 months. Also, if you no longer live in the country, that should mean the check is good till the validity on the document.

Contradicting information, so perhaps someone can clarify? I'd be somewhat hesitant to trust what the call centre says.
