Hello,

My wife and I are about to send all of our documents for the spouse sponsorship and we noticed on the checklist it says Please send original police certificate. I saw on the Canadian immigration website that you don't need to send it and if they do need it they will notify me. I just want to know if that is accurate. I want to make sure i send all the appropriate paper work so it does not delay the process. Thank you for the help.

a police certificate is one of the required documents on the checklist for your application, so a police certificate for the applicant (the person being sponsored) needs to go in the package, or else they will consider it incomplete. at that point they will either allow you time to fix the mistake or send your application back. which one happens to your application depends on the person opening your package. either way, not including it will certainly delay the process.

Further to that, if you are submitting an Inland spousal sponsorship application, you can send it later, but you must include a short note with your application informing CIC. Otherwise, as stated, your entire application could be returned.

If you are applying via an Outland application, you must include this with your application.

We are submitting an inland spusal sponsorship. Can I get the police certificate here in Canada or do I need to contact the authorities from the states. I am from California.

you have to submit a request for each country you have been in for more than 6 months. since you are a us citizen, you definitely have to submit an FBI record. whether you have to get an RCMP one from canada depends how long you've been staying in the country.

the FBI request has to be done by mail, and you can find out how to request it here:

http://www.fbi.gov/about-us/cjis/identity-history-summary-checks/submitting-an-identity-history-summary-request-to-the-fbi

I do not know if they will mail the record out of the country. current processing time is 22 days.

*** since you are applying inland, you may want to see what others say if this is needed for your initial application. i applied outland, and i know it's definite. my suggestion is to look at the checklist to see if it's on there for inland applications. if it's on the checklist, then it needs to be submitted with the application.

may i ask why you chose to apply inland as a US citizen? From what I've read on here the inland process is twice as long, and requires you to stay there the entire time. The current processing time for outland is about 10 months, and you can go back and forth regularly. It's generally recommended for US citizens to apply outland.

Wow! The FBI processing times are down ~ 22 days now?!?! That's amazing, considering that they typically seem to hover ~ 6-10 weeks.

To the OP, you will need to download the FBI fingerprint card (FD-258, I believe), print it off and take it anywhere you can find, in Canada, that provides fingerprinting services. The prices range from ~$40-$60. You MUST use the old fashioned `ink and roll' method as digital prints, also known as Live Scan cannot be used. Even though the FBI website states that Live Scan is acceptable, it is NOT acceptable for immigration purposes with CIC. Apparently, sending the prints electronically from Canada is a no-no (can't be transferred across the International border).

You then mail the fingerprint card, along with the form (available on the FBI website) for your police check request, to their office in West Virginia. The cost is ~ $ 20.
