I think that a poker player can be considered an athlete only if he plays for a club or if he always plays in legal casinos. But I think that immigration policy does not imply online games. My sister talked to lawyers via video link when she was supposed to get a residence permit in Canada. If I were you, I wouldn't offer myself as an athlete if I just played poker.
