I am writing this on behalf of a friend of mine who really needs some advice:
He is a Saskatchewan Provincial Nominee with an employer specific closed work permit and applied through this for PR in Oct 2015.
He received AOR January 8th 2016.
He has a non-accompanying dependent who he was unable to provide a medical for. After providing IRCC with a statutory declaration acknowledging that he will not be able to sponsor his dependant in the future & providing proof that he has made several attempts to convince her mother to allow their daughter to undergo a medical he received a Procedural Fairness letter from IRCC.
This letter included a new Statutory Declaration for him to sign & have notarized and stated that they will make a final decision on his case after June 28th. They also informed him that if he feels his case warrants Humanitarian and Compassionate relief he should provide evidence of this.
He has a girlfriend (not yet common-law) here in Canada (she is a PR and has no other family member living in Canada) and they are expecting a baby together in 8 weeks. So he provided all of this information to IRCC in the hopes that they will waive the medical for his non-accompanying dependant.
The BIG problem now is that his current employer is planning on declaring bankruptcy within the next month.
His CIC portal states that a final background check is in progress and he will be notified when they come to a final decision.
He has ordered GCMS notes (due August 7th) and emailed his MP (no response yet).
Is there anything that he can do should his employer declare bankruptcy? I understand that this may stop his application and his closed work permit will no longer be valid. Is there anything that he can do now?
