Now I am confused on what visa we should apply for...

Quick background.... My husband applied for his Visitor visa 2 times before married and was refused both times, as the officer did not believe he would return to his home country... After we got married we were advised to apply for the PR visa under the spouse catagory....

So that is what we were planning on doing...But now I am so confused what we should do...

2 days ago my husband's uncle told him to apply for his visitor visa (for the third time)as now we are married, they would give it to him no problem to visit my family for a month. After he arrives in Canada he can just extend and extend for up to five years and then he will be granted his PR.

His uncles nephew has done this from Australia no problem...This way if we continue to extend and extend we do not have to be seperated for 6-12 months ...

or should we apply for Visitor visa and continue to extend while we apply for PR visa??????

I know each case is different and nothing is for sure but your advice is greatly appreciated as I need to choose in the next few days before I leave my husband...

It will be very hard for the Embassy to give him the Temporary resident Visa (Visitors) because they KNOW he will want to stay in Canada.. and they don't like that at all!

Australian Nationals can come to Canada without a Visitors Visa, however your partner comes from a country that NEEDS a Visa Before they get to Canada. Also At this point, it will look pretty back if he continues to ask and be refused Visitors Visas!.

No disrespect intended, but your husband's uncle doesn't know what he's talking about. First of all, you can't compare what someone supposedly did from Australia to your husband's situation because Australia is a visa-exempt country and, if your husband has been refused visitor visa applications twice already because they don't believe he will return home he is NOT from a visa-exempt country and they will most certainly refuse him another visitor visa now that he is married to a Canadian. And, even for persons from visa-exempt countries . . . getting to Canada and extending temporary status for five years to be granted PR is not how it works. If you want to live and work in Canada, you need a Permanent Resident visa and that needs to be done properly. People who abuse the system only cause problems for people who are trying to do things the "right" way.

You need to file an application to sponsor your new husband for Permanent Residence. Once he gets his PR visa, he can come to Canada to live and work. If you are a Canadian citizen you can apply to sponsor him while you stay with him in his country, if you want to - but, unfortunately, other than that there isn't much chance of your avoiding separation while awaiting finalization of the process. Many couples are temporarily separated during this process, so you're in good company.

You don't say which country he's from so I can't tell you how long it will take - but if you post that information we can give you a better idea of what's involved and how long it will take.

My husband is from Indonesia what is the timeline from here???

I also want to believe that him being Muslim will not be a factor in the visa process...Will it?

Applicants from Indonesia are processed through Singapore - their processing timeline is 3-7 months, plus add about a month at the beginning of the process for CPC-Mississauga to approve you as a sponsor before they send the file to Singapore.
