Dear Friends:

I am applying from US. For my accompanying spouse, do I need to send only the passport photocopy (Bio-data) or also the photocopy of her Visa. Here is what the VO checklist says, and I have hard-time understanding it.(But I did, pass the IELTS, lol). Please read the sentence in red.

TRAVEL DOCUMENTS AND PASSPORTS
• Passports or travel documents for you, your spouse or common-law partner and
your dependent children. Include only copies of pages showing:
• the passport number,
• date of issue and expiry,
• your photo, name, date and place of birth.
• If you live in a country different from your nationality, include a photocopy of your
visa for the country where you currently live.

• You must hold a valid regular passport; diplomatic, official, service or public
affairs passports are not valid for immigration to Canada.

Please help me, I am applying from Buffalo Visa Office.

Thank you in advance.

There is a colon after the first bullet point, which implies you should send the biodata page and visa page for spouse as well. The first bullet point indicates for you and your spouse.

Even if I am wrong, the cost of photocopying is low enough to be affordable.

Hi,

Yes you do need to send the copy of the visa for your spouse and the reason being is that visa officer wants to confirm that spouse is residing in the country legally as she is also included in your application so they need to check all these things.

Cheers
Saki

Hi saki and other seniors
What about the child born in UK do I also need to get a visa for him/her eventhought under the British law children born in UK can live in UK without any visa as long as they do not leave UK and need to re-enter what should we do in this situation I do not have a visa for my two years old daughter because she Does not need it in the mean time to live in UK Legaly does this harm my application to CHC London .

If you child has a british passport then of course, he/she won't have a visa. If your child has a non-British passport, then explain that the child doesnot need a visa in a cover letter.

Ok here is my problem..................

I have 1 year US student Visa, which expired a long time ago. But I am still in legal status because I have a valid I-20 from my University, OPT card approved by USCIS few months ago, and I-94.

Is that 1 year expired visa gonna create a problem for me as I am still in status in US? I guess many people have similar problem........... Or am I a unique case, who has to go through this all.

Also, Do i need to send the certified copy of I-20 and Work Permit?

Please help me

where your F1 is expired or not, you have to send in photocopy of I20.
I sent in F1, I20 and I94 photocopies.

If I were you, I would send in all relevant photocopies. Photocopying is cheap enough that you can send in a lot.

The legality of your status in the US won't cause a problem when you submit your application to the CIO. I've read somewhere in this forum that some people were able to get Canadian PR status even though they were out of status in the US. What the CIO requires is that an applicant has to have stayed legally for at least one year in the US.

It should help your case if you send copies of your I-20 and Work Permit.
