After our marriage, my husband and I in a joint application applied for Permanent Resident Status to Canada with my husband as the principle applicant. Before marriage my husband had applied for Canadian Visa as a single applicant but his application was rejected. He took advantage of his married status and my post graduate qualification to garner additional points and hence our joint application was succesfully accepted in Skilled Worker Class Category.

However soon after the Visa was stamped he deserted me and left for Canada alone.

Pls guide me as to how can I pursue a course of action from India on grounds of desertion against my husband since he has left me here and is now currently in Canada.


Can the visa now be nullified by the Canadian Govt. ?

in my opinion why dont u go for a good lawyer as he can tell u all the loopholes that can be taken care of.
did he applied alone or u both applied and got the passport stamped??

I do not have much experience, so my reply is based on general information and not based on legal information,
-I do not think if you can request Canada govt. to take action against him
-You may file a case of cheating against him in India court
-I hope you would be having Canada visa, & you are PG, you can select option to move Canada & persue your life there.
There could be two option of retaliation,
1.Bring him to justice (which may take enough long time)
2.Move to Canada, work hard, be successful and beat that idiot.

I suggest you to read the article on Fraudalent marriages on www.cic.gc.ca i hope it will give you an idea on how to pursue this... if you can prove that he married you just to take advantage for immigration and there is no other reason he could have left you than you can get the guy in a court...

Wow, I am sorry to say this, but your husband is such a low-life piece of garbage to do this to you. I have no doubt he will get his due because what goes around always comes around. My prayers are with you.

I would suggest you contact a marrriage counselor/lawyer in your country, and also contact a Canada immigration attorney for your case. I believe not all is lost for your case. But the lawyers will best be able to guide you further.

I hope your husband's conscience keeps him up at night.

-Both of u [especially u] have your Canadian PR Visas, right?
-U r well qualified, thus r street smart as well, right?
-Probably u r currently employed too, right?

Now read carefully...

At this juncture it'd not be wise for u to rake-up a legal issue. And neither take any recourse with CIC. 'Coz, in such a situation your own PR Visa would be at stake. And to be practical - your moving over to Canada would be ideally wise any day, than continuing at your homeland. Probably that was in your mind/s too, when u chose to apply, wasn't it?

Besides, a judicial recourse would be both - time consuming, as well as financially strainful. U'd better use that resource towards moving forward - in life & attain a gainful position hereon. Moreover, the amount of public whistle blowing involved - would sure make u very uncomfortable, personally. Thus, it's better avoided.

Therefore, any of the 2 actions could potentially take your Visa Away, which would put a spoke to your future; besides u may yet not be able to bring him back, or get his cancelled. As he's landed, he'd find any & many ways to thwart any deportation order. Thus, your "revenge" might be lost in the red tape jargon.

Canada, among many other things is an utopia for single ladies. The opportunities r galore. Safety & comfort for u would be second to none. And believe me, once u r here, the law would ensure that your Ex bears all your expenses... They beat the s-h-i-t out of abandoning/derelict spouses, rest assured.

So, muster all your resources & make it to this beautiful country. Do not divulge anything to anyone. Once landed, settle down, establish yourself (I know it's easier said than done) & in a couple of months file a legal case against the Ex, as if the matter had gone sore here.

This way u'd get to remain/retain your PR & fetch social services to assist u as well. Besides, reside in one of the world's most fab nations.
