I would like to kno if I am eligible to live in Canada with my 3 kids, ages 13, 11,4.. I came to Canada in 1995, got married a year later and moved the Michigan USA, I had many problems with my husband right after our marrage in one month... I've been coming back and forth living here few months and living there... My kids are American citizens, I still have my social insurance and landed immigrant document. I have filed taxes in Canada for few jobs that i worked in the passed 2 years..I never applied for Canadian citizen because I was told I can not have dual citizens. My husband is now threaten me and I'm scared to be with him, I have no one in the states as my family lives in Toronto... Am I eligible to bring my kids and live here? I don't trust living close to him... What are my right here? Can my kids have PR cards and go to school? I don't kno what to do and who to talk to, I am open to any suggestions! Pls help me!! Thank you very much for taking ur time to read this...

You can have dual citizenship(American & Canadian). As a permanent resident, you can live in Canada. However, you have to sponsor your kids for permanent residence in Canada. You have to be residing in Canada to sponsor them. Note that immigration Canada will require documentation showing that your estranged husband agrees with you bringing the kids over here, custody order/arrangement from court, etc. This is Canada's way of ensuring they are not aiding and abetting the kidnapping of children by parents(not saying that's what you are doing). If approved, your kids will have PR status and receive PR cards. You can find out more from the sponsorship section of this forum.

Note: Make sure you have met residency obligations(730 days of physicial presence in Canada in every rolling 5 yrs) before you apply to sponsor your kids. If you apply without meeting residency obligations, you could create problems for your own PR status. Note that if your husband is a Canadian citizen, then you can also count the days you spent accompanying him in the US.
