Pls. Help: Refused Work Permit Renewal

Hello. I would like to ask if you can give me advise or suggestions on my current situation or any of you have the same situation and what have you done to get your work permit.

I am the spouse of a PGWP holder. My Open work permit will expire on Aug. 30, 2014 and currently employed. I applied for renewal/extension of my work permit but CIC refused my application because they said "it has been determined that you are not a person whose employment will create or maintain significant employment, benefits or opportunities for Canadian citizens or permanent residents".

"As the spouse of a holder of a Post Graduate work permit, you have not provided sufficient evidence to prove that your spouse is employed in an occupation that falls
within the National Occupation Classification Skill level of 0, A or B. You may be eligible to re-apply for a work permit if you are able to provide proof that your spouse is a skilled
worker in Canada, which may include a letter from your spouse’s employer, stating his/her job title, duties, and salary. If you cannot prove that your spouse is in a skilled
occupation, your application for a work permit cannot be approved without a Labour Market Impact Assessment from Employment and Social Development Canada."


My wife who is the PGWP holder just graduated last June is actively searching and applying for jobs. I am also thinking of discussing this to my employer so that they might be able to help me thru LMIA. I currently work for Maple Leaf Foods as MRO Specialist (NOC Code 1215).

We are also in the process of applying for our Provincial Nomination thru Master's Graduate Stream. If in case we got approved with our Provinvial Nomination, I am thiking of applying again and presenting my certificate/nomination (but I heard even if you have nomination CIC will or might require you LMIA/LMO).

Hope you could share me your experience or knowledge about my case. Thank you.

You don't qualify for an open work permit renewal at this time because your wife is now on the PGWP but doesn't yet have a job. Once she has a job, you will be able to renew your work permit.

Thanks Scylla for the input. Im just really wondering I have a good job and its in skill level B but still they refused my application.

I will try again to submit for another WP extension if we got approved with our PNP Nomination.

I'm not sure what you are asking. It doesn't matter how good a job you had. Because your wife doesn't have a job yet and is now on the PGWP - you don't qualify to extend your open work permit.

Hi,

I just want to update that I've got my WP extended for 3 years same as my wife who is a PGWP holder. My wife doesn't have a job yet (but still actively seeking). I'm not sure if the PNP Nomination helped us because most of the post I read here that have applied for WP extension was asked for LMO/LMIA. Thank you Lord :)
