PLEASE I NEED HELP!!! Visitors Visa wants to apply under Live-in Caregiver

I have been researching all around but I couldn't look for an answer . Please i really need help. My sister has a multiple visitor visa and we found someone to sponsor her under Live-in Caregiver. We have already her LMIA, police clearance and other requirements. We are planning to send her application in New York visa office but her visitors visa will expire (6 months) on October 10. Do we need to apply for extension first? or will it be okay if we send her work permit application now??

You can submit her WP application, if visitor timeframe expires you will be under implied status.

Nope, apply for a work permit overseas doesn't give you implied status. She would have to apply for an extension of her visitor status prior to it's expiry.

Thank you so much!! One more thing they said we should apply 30 days before visitors expiration can we apply earlier? and is it okay if we apply for the extension and work permit and the same time?

1. You apply to Vegreville for the visitor permit extension. Yes, you can apply earlier.
2. You apply to New York for the work permit.
3. I assume she has a US visa, because there will most likely be an interview
