I need help guys, my wife just received this email today. I really need advise please. We have been going through so much frustration over this application.

Applied date: Nov. 2016
I'm the husband, sponsoring my wife from Sri Lanka. Our VO is Colombo.

This is the letter we received \/

"Dear __________,

I am in the process of assessing your application and it appears that you may not qualify for immigration to Canada as a member of family class.

Pursuant to section 39 of the immigration and refugee act, a foreign national is inadmissible for financial reasons if they are or will be unable or unwilling to support them selves or any other person who is dependent on them, and have not satisfied an officer that adequate arrangements for care and support, other than those that involve social assistance, have made.

After reviewing your sponsor's financial situation as well as your ability to financially support yourself in Canada, concerns exist with regard to the finances available to support you and your sponsor in Canada.

Before I make a final decision, please provide a plan in writing as to how you propose to financially support yourself and what arrangements have been put in place for your financial support in Canada (with supporting evidence).

You are given 30 days to comply with this request. Please be informed that failure to respond/ provide documents within the timeframe provided could result in refusal of the application.

If you choose not to respond, I will make my decision based on the information before me, which may result in the refusal of your application.

Above is the letter she received as a response to our outland application... :(:(:(:(

I don't get it, we don't even have any kids.. why is financial support a huge problem? I am currently employed so as long as I have a job it didn't matter (at least that's what i though.. once she get here we can always figure something out in regards to jobs). What are the options we have right now? And should I call a lawyer to help me?

also let's say just in case this application get refused, can I take her to Canada as a visitor and then re-apply as an Inland application?

I am employed full time, but my wife just graduated from university so she is not working at the moment.

She is from Sri Lanka and I'm from Toronto.

Application type is Outland.

Did you attach supporting document, ie tax notice of assessment and proof of income?

yes, we did those things at the begining when we sent the application to Mississauga and then again when they requested these documents back in March..

That's weird... as far as I know, there is no income threshold for family sponsorship. You should be able to get through even if you are unemployed.
Do you think there is any reason they think your proof of income and/or tax notice of assessment are invalid?
I think that will likely be the case, given they requested such documents twice...

And did you send them your tax notice of assessment?
Yes, back in December and again in March. I received my SA back in November as well.

Then... I think you want to consider writing a letter. I found a previous post mentioned:

No if you get denied you will get denied for a TRV.

A TRV is a visitor visa. Since you have applied to sponsor your wife they will suspect she is not a visitor and doesn't plan to return home. To visit Canada one has to prove that you have strong ties to your home country so you will return.

Yes you can get letters from your family saying they will support you if necessary along with their financial information and proof employment. As mentioned previously you should include a detailed budget and description of what you will do when she arrives.

I just went through your post and thought of providing some information .

so sorry to hear about this , dont worry you will get a positive reply soon

Even we had a financial line when we tried to submit our application but we just followed some steps and this forums helped me to provide proof of income support
1. Verify whether there is any social assistance record and take acknowledgement from them if that is cleared out
2. provide bank statements of your wife if there are funds to support in her bank
3. Get the letter from your job location that you are working for them and have enough funds to support her.

Give things like finances (joint finances), your family's savings and investments, PA's employability, over all write a plan with supporting docs making it clear to them that you guys can support yourselves for the length of the sponsorship undertaking with ZERO social assistance from the govt. You can write things like that the PA will upgrade her education in Canada in XYZ field and then apply for jobs in an XYZ field (show screenshots of research). And that both of you plan to work in the long term to support yourselves. The text of the letter is leaning towards the visa officer's dissatisfaction with the PA's ability AND WILLINGNESS to help in supporting herself for the length of the sponsorship undertaking period. So a detailed plan on how you guys will go about supporting yourself beyond sponsor's current employment is what they are looking for in my opinion.

There are cases where even the Sponsors arent working, but they get approved without much difficulty. It really depends on how you make a strong case for yourselves and explain your concrete plans (refer to the points mentioned above). All they want to see is that you guys have a plan and will not ask for social assistance.
