HI,
I am under Contract LMO valid until 2016/09/28, my application for PR has been sent and is being precessed sent it out about 4 months ago i am hoping to have an answer soon.
About a month ago i twisted my ancle real bad and was away on sick leave had doctors notes for it. When i produces a doctors note to my employer he informed me that there might be no work for me when i return from sick leave. after a 2 week sick leave i contacted my emplyer asking to be put back on the schedule he informed me to wait. which i did. Now today he informed me that i should look for new work..Also the oryginal business owner who was helping me with the visa application is no longer part of the company.

I also have a common in law that i have been living with for over a year.

So my question is this

can this employer terminate my visa even though he was not part of the application process?
Can i apply for an open work permit?
Any way possible to change visa conditions?
Or should i just wait for my pr?
Can my common in law help me apply? and if so do i need to start the process again?

PLEASE HELP

Job Offer........
Pre-Assessed..
Your employer can not invalidate your work visa regardless of whether he was a party to the application process. He may however lay you off like he could any other employee if there is shortage of work.

For you this means that you are unemployed but still have a valid work visa and may stay in Canada as long as it is valid.

You can apply for EI but this is a hit and miss sometimes as they could say that they don't give you benefits because you are unable to take any job they may find for you because you would need an LMO.

As for your PR application, it depends on the application type. If you applied based on your LMO and full time job offer from this employer, losing the job could well affect your PR application. Worst case, if you lose your PR application, your common law partner could sponsor you. This would mean starting the process over again.

I am not sure under which program you would qualify for an open work permit. If you are a PNP applicant, you can talk to your PNP program and ask them if they can get you a work permit without the need of an LMO if you find another employer. Otherwise, if your common law partner applies to sponsor you inland, you can apply for an open work permit as a part of that application and you would get it in about 4 months.
