My name is JO.Now I am from INDIA. I would like to know something about my visa. I got married previously but not legally divorced but now separated .. My 1st wife's name is included in my passport. its not removed. But I have a common law partner she is in CANADA. She got PR there.. We stayed together in INDIA and also in foreign country. But me and my partner not legally married. my doubt is that how can i get a visa to CANADA to live with my partner.. she is not married. and also want to know is there any possibility to get a visa with my first wife's affidavit that we are not living together and have no relations now. So please help me to live with my partner in CANADA.. PLEASE GIVE ME AN ADVICE THAT HOW CAN I SOLVE THIS PROBLEM..

Your common-law partner can sponsor you for permanent residence, provided that you were not already common-law (lived together for minimum 1 year) at the time she became a PR.

(If you were already common-law then, you will be refused, as you should have been listed as a dependent on her PR application.)

You'll need to show you're separated from your wife, and have lived together with your partner for at least 1 year, but there is no problem with you still being legally married, provided that the marriage has in fact broken down.

By your advice you mean that me and my partner have to live together for more than 1 year in INDIA or anywhere again before the submission of application. For that living time what all documents that we have to submit to prove it. And also what document I have to submit to prove that my first marriage is broken down in fact. please give me the reply.
