Hello -

I'm looking for some help here.

I got married back in Nov 2011, and my husband [who was a student in canada at that time] had to leave for Canada in Jan. Since then i have been trying to get to Canada.

My TRV application was refused twice in year 2012.

However later ,due to some unfortunate events he had to apply for refugee protection.

It has come to my knowledge that the whole process could take 5 years. This has adversely affected our relation and there are chances of marriage breakdown, because of my visa issues.

I want to get to Canada immediately to save my marriage. I am confused as to which category i would fit into ?

what would be the fastest way to get to canada and how?

Anyone with an open heart, please advise !

Yep - its a sad and unfortunate situation. Yet, I'm sure there must be a way that you can get around to it.

You are asking about fastest way to get there. But the important things - whatever you use to get entry into Canada, will that way help you to stay there. Because, i believe your main aim is to stay with your husband in Canada, right?

There are couple of ways you can get into Canada:

#1 - Visit Visa - Since you have already been refused twice, there is no use in knocking that door again. Just for my understanding, may i know why they refused? Did they give any explanation?

#2 - Study Visa - This is an expensive way. If you have enough money and suitable educational background, you can get admission in any college. You dont have to go for whole 4 yr degree. Just get admission in any 1 year post graduate program. After you finish your 1 year of study, the government will automatically provide you with 1 more year of Post Graduate Work Permit (PGWP). Meaning, you will be allowed to work for any company (or companies) for 1 year. You can read more about PGWP in the link below...

After you have worked for 1 year, you will become eligible to apply for immigration in Canada through Canadian Experience Class (CEC) application. You can read more about CEC immigration from the link below:

So your husband will NOT need to sponsor you. But i know, this way will cost you around $14000-$16,000. Since your TRV application was refused, you will need to convince officer you are really going for studies. How you can do that?
1- Full financial support - from your family. Your funds in the bank account should be way more than the cost of your tuition. This will assure the officer that your family can easily support you.

2- There must be some relevance to your past educational background and the program you choose in Canada. If its completely random, the officer may reject it suspecting your intention. So try to have some relevance. And lastly, you must have an awesome IELTS score ...preferably 6.5+

But the first thing which I'm unclear about, your husband should have consulted with a lawyer about the best possible way. Has he done something?

I think there is extremely little chance you will be approved for any sort of temporary visa at this point (visit, student, worker). To be approved for a temporary visa, you must demonstrate that you have strong ties to you home country and have no plans to remain long term. The problem is that you are married to someone who has claimed refugee status. I believe CIC will assume you want to remain in Canada long term as well and will deny your application.

I would strongly suggest you to ask your husband to get in touch with a lawyer and consult his options.

1 - Is there any he can get you in Canada. How long will that process take and what are the chances of success in that process.

2 - If there is no chance that he is able to help you, how much would it matter if you come to Canada on a Study visa. I know that there is a risk, but it doesnt hurt to try. Its only a matter of convincing the officer that you are going to Canada to have a prosperous future. Double intent is completely acknowledged by CIC - which means that Canada realizes that foreign students who come to Canada want to reside in Canada permanently. So there is no harm in knowing that you want to study in Canada and once you are done with your studies you want to reside there with your husband and also make a living of your own from your education.

Best thing is, get in touch with a lawyer in Canada. And don't loose hope!

I am still stuck here. The situation is even worst and frustrating. I am no longer in contact with my husband. I really need to go to Canada. He filed his refugee claimant appl. thru a lawyer and that lawyer is not good. She was just anxious to eat money and didn't tell the consequences of filing a refugee claimant appl.

I am a software engineer having a well-established job (sr. Manager). i get paid in dollars and have no financial issues.
I have also applied for federal skilled worker program under NOC 2174. But i don't know if i will fall under the cap ....my application was received by cic on jun 26th but i haven't received any ACK as of yet.

I am thinking of applying TRV once again and telling them the truth. I actually want to visit him ! that's it. Just so we could resolve our issues. I want to know what made him think about divorce thing. I am so screwed up ! my marriage is ending just because we couldn't meet each other and he is stuck there for next 4-5 years and CIC took his passport.
