Please help! IMM 5604! Sponsoring spouses kids.

Hi I would really appreciate some help. My situation is this.... I recently sponsored my spouse and we are now in Canada, and we would like to bring his daughters here because they have a change to have a brighter future here. My questions are these

1. Can my spouse sponsor his daughters even though he was recently sponsored? Less than 2 years

2. Do We need to go through the hassle of getting court legal custody papers if my husbands ex is willing to sign the IMM 5604?

Please help I've searched for answers but have had no luck :'(

Were the daughters declared as his dependants in his application for PR and medically examined?
