Please help Experts!! - LMIA Applicatin for PR and PGWP Expiring

Hi everyone,

I have a question regarding LMIA application to support the employee's PR application.

My PGWP is expiring next month, but if my employer submits the LMIA application for my PR (the free one) before my visa expires, am I eligible to submit WP extension application???

I am thinking to ask my boss to apply as it's free and I am doing it only to buy some time.
Please help if anyone knows... thank you!!

LMIA can be done even if you're out of work permit. But you have to maintain your status. You could apply for visitor visa to keep your status.

Also if your employer gets LMIA then you don't need WP extension. LMIA means you get a new work permit on which you'll be working only for that particular employer.

Thank you for your post!

But does LMIA for PR Application grant you a new work permit? I thought it's different from the regular LMIA because its purpose is only to support the employee's PR application. I am not sure how it works, but I assumed if it is approved, it will just give you 600 points but not a new work permit. Am I correct?

Yes you are correct. There are 2 options. 1 - LMIA for PR (free). 2 - LMIA for work permit (costs $1,000). My boss applied for the second option because my WP was expiring and the first option would not have given me a new WP

Do you know if i submit option 1, and my wp expires but lmia is approved later, do i still get 600 points??

Yes, you do get 600 points. But without authorization to work in Canada you will have to provide proof of funds.

Thank you! So... even though I am eligible for CEC, i should still provide proof of funds?

No, if you are eligible for CEC and if you get ITA under CEC you don't need to provide proof of funds.
Note that if you're eligible for both programs, you'll get ITA under FSW.

yes you will still get the points regardless of whether you have a WP or not. If you have not WP, SC will probably contact you or your employer to find out what your status is (to make sure you are not working illegally) before they approve it, so you may have to show proof of implied status/visitor status/restoration, etc.

If your boss will apply for the (free) LMIA, it's a good thing to help you get PR, but it won't help you at all with a work permit.

You can submit an application for a work permit, but you aren't eligible. it will be refused, and it won't buy you much time. If the LMIA is approved, it is unlikely to be soon enough to enable you to apply for a BOWP. You will have to either leave Canada while waiting for your PR application to be processed, or stay as a visitor (if you can afford to).
