Hi there,

I am recently concerned about my work experience since one of the companies I've worked for in past is shutting down. I am very worried and concern that my application will be rejected.

I have listed my employment history in Canada and highlighted my questions.

Note: I have gained following work experience after finishing my degree in Canada and also sent my application in August 2012 to Sydney. I noticed my credit card was cashed yesterday.

Company #1:
Hours: Full time - 36 weeks, 40 hours – Total Hours 1440 hours
Position: Game Developer, NOC 2174 - Type A
Date Worked for: 25 April 2011 to 01 January 2012 (9 months)
I worked here for 9 months and attached a letter of employment, my contract, some of the paystubs, notice of assessment, and T4 to my application.

Question: I recently heard the company is temporary shutting down and no longer is in operation. Would this be a problem for me later? What if CEC contact the company and they don't answer?

Company #2:
Hours: Full time - 12 weeks, 40 hours – Total Hours 480 hours
Position: Game Developer, NOC 2174 - Type A
Date Worked for: 25 April 2012 to 01 July 2012 (3 months)
I have been working here since April 2012 and attached letter of employment, my contract, and paystub from this company. I didn't have my "Notice of Assessment" since it is not end of the year yet. I am also still working for this company to present day.

University #1:
Hours: Part Time – Contract basis – Total Hours 400 hours
Position: Research Assistant NOC 4122 – Type A
Date Worked for: 13 February 2011 - 20 January 2012
I have worked part-time as a Research Assistant and have attached letter of employment, my contracts, paystubs, notice of assessment, and T4.

Question: I was doing this work while I was employed in Company#1. I was mainly doing this job from home during weekends. Does this experience still count?

I really appreciate it if you you guys can help me out.

Yes, it could be a problem if CIC cannot verify your work experience. Contact the person who wrote your Letter of Employment, try to find alternative contact information for that person, and when you get your file number, you can send a letter of explanation to CIC.

BTW - if it was full-time employment, the number of hours worked per week are not really relevant. (Any full-time job would be calculated at 37.5 hours - in this case, 36 weeks * 37.5). Not that it matters in your case, I estimate a total of 2200 hours over 18 months, it should be OK -

The experience would count, and you do need it to meet the work requirement... But... If you were doing this job while employed in Company 1, you were not a student - already graduated, yes? If so, then this is the wrong NOC - 4122 is for student research assistants. The correct NOC would be related to the professional occupation - whatever you were researching - I honestly don't know if this will cause any problems.

4122 is the code for research assistants on the 2006 NOC list. The new code is 4012(2011 NOC list). It does not depend on the type of research - as long as the main duties and responsibilities are consistent with the NOC code, he/she can use it. I know of a research assistant(working in clinical research) in a hospital setting that used code 4122 and obtained PR. Sometimes the job title, location, etc does not fit 'perfectly' but still falls in the group.

@ home3d - as long your main duties and responsibilities are consistent with those of NOC 4012, your research assistant experience will count. I hope you had an open work permit.

Thank you so much for your respond. I really appreciate it.

I graduated in January 2011 and got my PGWP in February. All my work experiences are after graduation with a valid work permit.

I will ask my university to setup a new letter based on NOC 4012 and will send it along with a letter of explanation to cpp-o when I get my AOR.

Question: I am still working for company#2 and was wondering if I can still send my pay-stubs and a new letter of employment (around Oct or Nov2012) when I receive my AOR? I sent my application to Sydney in July 2012 , my pay-stubs and reference letter showed records of employment till then. I also noticed my credit card was cashed today.

I talked to my boss today and he told me he will provide me another letter of reference in Oct or Nov. By doing this, my record will show I have worked for company#2 from April25 20212 - Oct2012 (6 months).

Do you think immigration still count my work experience from (July - Oct2012) after I received my AOR?

I really appreciate it if you guys help me out.

No. Your experience will be considered from the date your application was received by CIC. You must meet the requirements at the time you apply.

We all know that the NOCs are not an exact science, and people succeed all the time with the wrong NOC. Others have their applications rejected because of the wrong NOC.

4122/4012 is for students who are enrolled in university and working as RAs/TAs. There are discipline or profession-specific NOCs that cover non-student research positions. It may not be a big deal, I only point it out because of the possibility for confusion (e.g. IO thinks, "Are you applying as a post-grad? then student work experience doesn't count..." I realize you say you already graduated and had a work permit, but the potential for confusion is there...

I am going to wait and see what happens next when I receive my AOR. It is so frustrating to see your life is in the hand of other people. I have worked hard for the past 8 years and now I should be worry every single day knowing that there is no guarantee to get my PR. Sigh!!!!!
