hi,

i have pr card. but the problem is i came back to Pakistan and got married to an army officer. now i have a son born in Pakistan and i want to go back to Canada. i can not sponsor my husband because he is army officer (serving) can't have dual nationality. but as my parents are moving very soon to Canada i want to go back for my sons future. what shall i do? i don't want to leave my son here as he is on my feed and is an infant. even if i have to loose my pr status i don't want to go without my son?

kindly help a worried and depressed mother.

If you want to leave your husband and move to Canada with your son, you need to find out if you can do that legally in your country. If you don't have a way to do that, then I guess you are stuck.

thanks a million for your reply. according to law i can do so. plus i think u misunderstood me i am not leaving my husband forever God forbid. but currently i cannot take him along because he is serving army officer, if i sponsor him he cannot leave the country until he resign according to military rule.
ya i will sponsor him later when he retires from army or when he quits.
so right now i just want to take my son with me. do u have any information i 'll be really thankful to u.

You said you are already PR but you have to sponsor your son. Talk to the embassy in Pakistan about what you have to do. As a PR, you have to be in Canada before you can sponsor him so ask if you can get a TRV for him to come with you.

i talk to the embassy already for the TRV they are saying i have to sponsor him. but the problem is i have to be in Canada to sponsor him but i cannot leave my child who is still on my feed. that's why i am worried. someone told me to sponsor him from Pakistan and then apply for TRV so that embassy can't say that why are you not sponsoring him??? that's why i thought to sponsor him.

You can not sponsor him from Pakistan, you have to be in Canada. Ask the embassy again if he can get a visa. Did they say you should leave the baby in Pakistan while you go and sponsor him? I know of a case where a PR couple had to leave the mom and baby in one country while the dad went to Canada to sponsor the baby. I know of another case on here where the father could not go and the mother was given a visa for the baby to go with her. Surely there is a way to do it. Otherwise you will have to wait until he is a little older and then go to Canada and sponsor him. How long have you been outside Canada now? You can not be away more than 3 years total, otherwise you lose your own PR.

You ask the embassy again, explain your situation and ask them if you are really supposed to leave such a small baby so you can go to Canada and sponsor him. If they say yes, then you email the minister of immigration, his address here: http://www.cic.gc.ca/english/department/minister/index.asp and ask him the same question. If he also says yes, then you have to decide if you will go to Canada before you lose your PR and leave your baby behind so you can sponsor him or if you stay in Pakistan with your baby and lose your PR.

Apply for a TRV for your son and advise the embassy that you are going to sponsor him as soon as you get back to Canada. MAKE THE APPLICATION. Of course they have TRV's and do give them for these purposes! When you do the application for PR for your son in Canada, you declare your spouse as "unaccompanying" but he will still have to be medically examined so you can sponsor him at a later date, when he gets out of the army.

If they refuse the TRV for your son, you will have no choice but to return to Canada and apply to sponsor him from here or you will lose your PR. Good luck.

A TRV might not have been given because the baby will likely not be leaving Canada but ask the embassy if a TRP is possible.

TRV is a temporary resident visa issued to tourists and TRP is a temporary resident permit, issued in special cases to people who are otherwise inadmissible to Canada. I believe mostly in refugee cases but I really don't know too much about it. Doesn't hurt to ask anyway.

i talked to embassy today they are saying why don't you use a representative who can submit your application from Canada. but do you think it's possible i don't think so. plus they said you have to sponsor the child. but i did'nt understand about using representative if it would be that simple it's not a problem then.
