Please advise on the sponsorship program for my boyfriend

Hi, I'm just new here in Canada (4mos to be exact) I would like to ask how can I sponsor my boyfriend from the Philippines? He's the father of my daughter...

Our problem is, he is married and they are not living together since 2004. Their annulment has already been filed 10years ago; awaiting decision from the municipal court.

Also, do I need to have a full time or regular job to sponsor him?

Please advise us what are we going to do first and what is the appropiate sponsorship program for him.

I think 1st the annulment would have to be completed. Second thing I don't think you can sponsor your BF unless you were at the very least living common law together and have proof of this. Otherwise you will have to wait for the annulment and get married if that is possible.

Thank you Christoph100. The annulment process in our country is very stressful. Maybe we'll just wait for the court decision.

You should try a conjugal application. Most common case for these apps is from the Philippines where divorce and living together with a married person, is illegal. In this case his previous marriage will not matter, even if still married on paper.

I am also assuming that you did not live with him at any time in the past for 12 consecutive months.

Also where was your daughter born, and if not in Canada was she included in your own PR application?

Before, applying for Sponsorship and getting married. Please do read the family Law and divorce act. As it is most painful and brutal. I have been a victim of marriage of convenience. There by keeping my personal experience. I am advising that one must understand these laws as once your spouse is here and left. Than you would be facing deepest depression of your life.

It sounds like you did everything right. With the child together, and if you can show proof of a true conjugal relationship (i.e. lots of pictures together, testimonials from friends/family, shared finances, etc) then you could have a good chance to be approved under conjugal.

There is no minimum income to sponsor a conjugal spouse, but you will need to show a financial plan that will convince a visa officer you won't go on social assistance after he becomes a PR. You can show any job you have even if the pay is minimal, or letters of financial support from family living in Canada.

Would you recommend to get a tourist visa first for my BF? He would like to visit me here in Canada. Is this possible even if he's still married?
