Hello,
I would like to ask for an advice. We are planning to move to Canada. I am a bit confused because my husband has a previous marriage in the Philippines and his annullment is still on process and we don't know when his annullment will be over. We got married here in the Middle East through Muslim rites. As far as I know that in Canada, 2 marriages are not allowed. If we will declare our civil status as common law, do we need to provide a divorce paper since I'm the 2nd wife? But we have 2 kids and in their birth certificate, we are married. I would like to know, what should we do in order for our visa to get approved.

You'll need to apply as a common law couple (I assume you've lived together continuously for at least one full year). Canada won't recognize your marriage since your husband is still legally married to his first wife and bigamy isn't allowed in Canada.

Thank you for your prompt reply. What about the documents that I will need to submit to immigration like police clearance, are all of them should not mention that I am married? Also, If it is common law, will there be any problem if in our children's birth certificates mentionss that we are married? Thank you in advance for your help.

It doesn't matter if those documents state that you are married. You will need to fully explain the situation.

I have one more question to ask. Will there be a chance that our visa be refused if there is no annulment paper from his previous marriage that will support our documents to immigration officer?
