Hello,

Sorry I am probably repeating something someone else has written but I am unclear through my findings.

I met my girlfriend in Poland back in June of 2012 and have been inseparable ever since (online/in person)

She came here in August of 2012 and received a 6 month visa, things have been going really well as we have been living together. We very much so love each other so we have planned to get married. I am just unsure on how to handle this process in the most efficient manner.

Is there any possible way that we can apply inland and she not have to return to Poland assuming it is not rejected, we are going to apply for her extension once the 5 month mark approaches.

On her visa it states she is coming to live with me and that I have sufficient funds to support her, I don't mind if she is not working but I just want to be with her.

Even if you get married today, chances are your application won't be ready. Police clearance can take months to come back. She would be better off asking to extend her stay.

Not to put a damper on things, but that's a very brief relationship. Immigration will look at it very hard. You should too. You'll sign a paper promising to support her for five years. If she divorces you and goes on social assistance, you will have to repay it. There's no rush as you have the rest of your life.

Any relationship less than two years is treated as "short."

I know this all seems short but as they say when you know you know.


I guess my whole question is yes I can extend her say but what can I do after that? I am assuming she will have to go back?

Basically what is the best way to approach this?

One thing to note is that I also have my polish citizenship through birth.

Get her to live with you for a year

first of all, you'll know your relationship is legit, second of all, it will make everything a lot easier

So basically have her live with me for a year on a visitor visa extension then approach the idea of marriage from a legal/cic perspective?

I know it's a shitty situation, but your alternative would be to either get married right away for "convenience" or apply under conjugal, which only has a 2-3% chance of being approved.

Now, did you look into the International Experience Program?
Not sure if Poland is a part of that, but that could get her a working permit relatively easy

you have several options... you can extend till you can apply common-law or, get married, apply right away and extend to keep her here while it is processing (if you apply out-land) or if you file in-land she would get implied status as long as the PR application was filed before her visitor visa was expired. or you can go back to Poland with her and apply from there once you have lived together a year. and then file showing intent that you will move back to Canada once her visa is issued... if you have polish citizenship you could live and work there during the process.

Yup

The IEC program gives her an open visa for a year, if she finds a job here, she can extend that program with another year through the Young Professionals program (If her employer is willing to extend the job offer) this means that once the open work visa expires, you can start the common law program through the second year.

That's how i am doing it

implied status comes with the submission of an in-land application for permanent residency, just means that it is ok for her to remain here while the application is being processed. it is highly recommended that while applying in-land you don't leave Canada if she does and is not allowed to re-enter they will consider her application abandoned and deny her visa.

Marriage is still another option. Although I would recommend not to rush the marriage, like civil marriage for marriage certification. Do it right, not for immigration purpose.

Even if she is allowed to stay as a visitor or with an implied status, most provinces do not give her medical benefit. You / she will have to cover everything until she gets PR status, including delivering babies (if it happens).

And inland application will not give an appeal right whereas outland does.

No matter what path you would take, it is advisable to start gathering evidences for your relationship, and focus on quality of evidence.
