Physical Presence less than 1095

Hey guys,

So recently I had my citizenship test and interview. During the interview I was told that I did very well for my test. However, my number of days of physical presence in canada is 1051 and not the required 1095. Apparently I made a miss calculation. So now my case is forwarded to the judge.


Here are my questions:
how long before I can see the judge?
Will they reject it or approve it (considering I have a high score on the test and I have lived in Canada for almost 8 years now, including time as an international student)
If it is approved, how much longer before the ceremony?
If it is rejected, what happens next?


It is a very stupid mistake I know. Any guidance will be appreciated.

definitely expect a RQ and hence start collecting documents accordingly

no i didnt use the online calculator and I feel so STUPID right now. What is an RQ and how long before I see the judge?

If you get an RQ then you are looking at 36-44 months timeline from the day you applied your Grant...
There is no timeline for a JH or a time for Oath...

Depends on how soon an RQ is issued, how soon CIC review it, if the CJ asks for an RQ/ additional info and ultimately when CJ has a time slot for you....CJ hearing adds 12-24 months it seems to whatever quoted timeline there is. You are at the mercy too of your Local Office and how backlogged they are. If you are in a fast Local Office and now have the 1095 physical days you should really consider re-applying as you will oath sooner than you can meet the CJ.

I think it's better for you to cancel your application and make another one when you fulfill the residency days ,because it will spend less than one year for your new application to get citizenship(with the new law 2014) ,but if you wait with your current application you will wait a long long long time (maybe 44 months), and at the end the judge may denie it.so it's your choice.

Apart from timeline which is 24-36 month, you will face stern questions from CJ on your 40+ days shortage. It's unlikely you will have easy ride on the hearing since you have not fulfilled the residency obligation. Your case is a self-made mistake on calculation error not on a compelling ground where CJ could sympathize on you. You might even face of total rejection and will be asked to re-apply after 2+ years from now..

Therefore, It would be wise to withdraw your application explaining in a letter that you made error on physical presence calculation and thus you will re-apply fulfilling the residency condition. This might be the best option.. Rest up to you.
