I have a 3 year "post-graduate work permit," which will be expired in about 2 months on August 17th, 2015.
Two situations going on here, First - I applied AINP at my company I'm currently working at and received the file number at the end of February, 2015.
Second, in March 2015, a "different" company/employer provided me a job offer and applied a LMIA for me. This second employer also received the file number on LMIA.
Both my current company (AINP) and the new company (LMIA) received the file numbers but no second approvals or decisions have been made.
I was told that under the "implied status," I can apply for a new work permit and submit a form that proves I have applied for LMIA (attaching file #, etc), and continue working at my current company while the LMIA from "another/different" company is still in process.
I would like to remain working at my current company (AINP) while on implied status..
So here's my question:
1) In order to continue working at my current company under the implied status, does the LMIA application or process have to come from my current company? Can it be provided from a different employer and still working at the current job?
2) Also, can this type of work permit, in this case, the post graduate work permit, be on "WORKING" implied status after permit expiry date if LMIA decision is still in process?
Anybody had similar experiences like me? I'm reading all these implied status information on government website but I can't seem to find anything that exactly answers my questions.. please help!
