I have enrolled in a 3 year bachelor's program. During the studies I had become a part time student and that was in one of the semesters. There was one semester where I was a part time student as I had dropped the course and I had only minimum courses and due to which I became a part time student. However, I did graduate and finished my degree progam. Due to this issue, my PGWP was refused. The PGWP refusal letter came after six months, since its application.
Now I had 90 days to appeal this decision. I approached an immigration lawyer and applied for restoration of my status. I have also provided additional documents and sincere reasons as to why I became a part time student. Since then, after three months, I received a second refusal on my application for pgwp. Now, according to the second refusal letter, it states the following criteria:
"As you do not meet this requirement, it has been determined that you are not eligible for a work permit in this category."
"You must leave Canada on or before the expiry of your current document or, if your document has expired you must leave Canada immediately. Failure to do so could result in enforcement action being taken against you."
Now I am confused as to what to do. My lawyer suggests that I should leave the country and re-enter again with my visitor visa that is still valid until next year. However, I am unsure if that is true. Student permit has been long expired so how would the visa that is on my passport help me to return back to Canada?
Can anyone guide me on what I can do next? Should I leave the country according to my lawyer? Can I apply for restoration of my student permit and continue to study and get enrollment in another program?
