PGWP pending and spouse refusal

Hello,

I applied for PGWP and my husband for OWP. When I applied I didn't have a job offer and my permit was about a couple of days to expire. A few days after submitting my application I got a job offer and I updated my application indicating my husband CIC and his application information to be updated as well. However, they refused my husband application and we have to go through a restoration process. My concern is that they just answer my husband application but not mine, I'm still waiting.

Have you had any similar experience? Is it normal or do I have to be worried about? Regarding the restoration, do I have to consider other important documentation beside my job offer? Do I need my employer letter confirming that I work in the company?

Your husband needed to qualify for the OWP at the time of application which was not the case and that’s why he was refused. He shouldn’t apply for OWPuntil you have PGWP, 3 pay stubs and a job in NOC 0, A or B. I assume he stopped working.

No, he didn't stopped working, in the refusal letter they said that if I have a job offer he can apply through restoration. As I mentioned before I got a job offer a few days after submitting my application. I have 3 months working in a NOC B, but I haven't received any update from the embassy, that's one of my concerns. Why they just answered his application (I'm main applicant).

Below my concerns. I will appreciate if you provide any answers for me.

If your husband is going through restoration that means he doesn’t have status so he can’t work. He needed to stop working as soon as you was refused. He never actually qualified to apply for SOWP if you not able to provide the 3 pay stubs at the time of application. Will let other confirm this. @scylla @canuck_in_uk

He needs to stop working ASAP. He is working illegally.

Ok. Chanuck,I just spoke with an immigration lawyer and he told me that he doesn't need to stop working. He has to apply for a restoration application and prove that I'm working, pay stubs and other things, and NOC B, so they see that I'm actively working and he is find.

Your husband has NO STATUS in Canada and is working illegally. That is what it means to apply for Restoration, that a person is in Camada illegally and needs to restore their status to legal. Applying for Restoration does NOT grant a person the right to work.
