My brother and I are currently living in Canada as students. The question that I have is about my brother who is pursuing a certificate in business level 2 that lasts one year. His study permit expires on August 31st and as of today, he has 4 classes left to complete his certificate. The plan is to take the four classes in the spring & summer semester which would mean that he'll complete his final exams for a couple of the remaining classes around August 22nd. At this point we see two options for him:
1) Complete his 1-year certificate and apply for PGWP after he gets his marks and transcript but this would mean that we'll have to apply for PGWP after his study permit expires as getting the final marks and transcript could take up to a couple of weeks, and thus passing the August 31st date (the expiration date for his study permit ). As I understand CIC allows you to deal with such situations with this option
"If your study permit expires before you apply
If you don’t change your status to a visitor and your study permit expires, you have up to 90 days after your study permit expires to apply for a PGWP and restore your status as a student.
To restore your status as a student, you must
My question would be which option is the safer for us to follow and what would be our options in case ta PGWP application is refused.
