PGWP expiring in first week October and employer just posted ad

Hi Guys,

I'm in bit of a soup. :mad: My employer after a lot of analysis came to a conclusion that they should file my LMIA but i guess they are late.

They just posted the ad on 9th may but i guess i do not have time left to wait for the processing to complete as my work permit expires in 1st week of October.

I am a software engineer with $700100 annual income in Ontario....So i guess i come under high wage.

Do i have any option to extend my stay in canada in case the lmia processing takes longer than first week of october.

Also what is the average processing time going right now

The processing time varies but after the mandatory advertising period you'll still have more than three months to file the application and await the results before your present permit expires. If you do not have a result by the time of your work permit expiry you can apply for a new permit using the LMIA file number. They will wait up to an additional 90 days for the result of the LMIA but if a result isn't available at that point the application for new permit will be denied.

However i wanted clarity on what you said as below:


"If you do not have a result by the time of your work permit expiry you can apply for a new permit using the LMIA file number. They will wait up to an additional 90 days for the result of the LMIA but if a result isn't available at that point the application for new permit will be denied. "

1) So if i apply for my work permit before receiving my LMIA result... i will be in valid status in Canada for additional 90 days .....and the proof of my status in Canada will be the application number of my work permit extension which i will have applied with my LMIA application number.................. Also will i be able to work during that tenure?

2) In worst case scenario ..what if even after 90 days the decision on my LMIA is not made and my work permit is rejected...?
