Once u get LMIA then you are eligible for Express entry and an ITA in the very next draw. No need to wait for a year.

Now the most important thing is that how sure is your lawyer to get a LMIA?

Hi, your lawyer is either lying to you or misleading you or both. The LMIA process has to be initiated and carried out entirely by the employer. It also has to be paid for (by the employer) and the employer (not the applicant) must submit all the documentation.

Further, the applicant cannot drive the LMIA process in any way.

You can read more about the LMIA process here:

http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=163&top=17

Note the sentence: "If you need an LMIA, your employer must send an application to Employment and Social Development Canada (ESDC)."

My suggestion: Get rid of this lawyer, and try to see what you can do to qualify for Express Entry. Improving your English language and/or French language scores is one suggestion. Play around with the CRS estimating tool to determine your rough CRS score.

http://www.cic.gc.ca/english/immigrate/skilled/crs-tool.asp

Good luck

There are many lawyers who have used 'fake' companies to try and obtain LMIA's for their clients. Often it ends up falling short.

In truth, most companies who apply for 'genuine' LMIA's for their clients are rejected as when they go through the recruitment process they are able to find skilled Canadians to do the job. The process can take 6 months or longer and IRCC conducts a lot of scrutiny for LMIA applications.

Further, generally the companies want to see a person and meet them 'in person' before having to conduct such a rigorous and time-consuming process.

The 'LMIA' is all about addressing the 'genuine' skills shortage in the Canadian Labor Market (hence the reason for many rejections). Further the so-called company your lawyer told you about will have a hard time justifying to IRCC why they are filing an LMIA for a person they have never met.

The only exception is if you have some rare skills/qualifications and the job in your occupation is in very high demand.

If some company ask you to pay money for LMIA then this is either scam or fraud. Even if you get your LMIA from that company, you may find yourself in trouble against "Immigration Canada" later on if they find about illegal activity of that company.
