Hello,

I was not able to live in Canada for 730 days in the past 5 years (as required to keep a permanent resident visa).
Due to several reasons, I have to stay at my home country. My card will expiry in August 12th, 2015.

Last month, I have received a PHD offer from a Canadian University that I am willing to accept. The start date of this PHD is September, 2014 and I will have to stay in Canada until April, 2015.

My question is: can I enter Canada with my permanent resident card or should I apply for a student visa? How should proceed in this situation?

Hi marcio23,

you can't apply for a student visa because you are currently a pr so this is out of question.
you will be able to enter canada as a permanent resident BUT it depends on the officer at the port of entry,if you are reported you will have to attend a hearing with immigartion and you will be advised about this by mail.
if you are lucky enough and the officer at the port of entry didn't report you then you will have no issues BUT you must remain in canada for 730 days do not leave for any reason until you meet the residency and apply for pr card renewal.
please not that if you applied for renewal of your pr card right when its expired without meeting the residency requirement,its going to be rejected and you will be referred for a hearing because you are breaching your pr conditions.
P.S:the 730 days does not have to be contunious if you can meet the requirement within a 5 years period starting from landing date but not pr issue date you should be fine.
i think canada does not ask for much when they require two years out of five,its pretty generous...people not ready to live hiere permanently should not apply for pr on the first place or at least if they travel a lot they should wait till they become citizens to start moving in and out freely without having fear of losing their status.
by the way when did you land as a permanent resident and how many months or weeks have you stayed in canada since then?
