HI,

I AM CURRENTLY WORKING AT THIS PLACE AND GET PAID ON HOURLY BASIS. I WORK 8 HRS A DAY N 40 HRS A WEEK. HOWEVER, I GET A CHEQUE FROM THE COMPANY ON SEMI-MONTHLY BASIS FOR 80 HRS (ON EVERY 15TH N 30TH OF A MONTH) . MY EMPLOYER ALSO REMIT MY PAYROLL TAX ON SEMI-MONTHLY BASIS. I JUST REALIZED THE CHEQUE WAS SUPPOSED TO BE ON BI-WEEKLY BASIS. MY ONE YEAR OF EXPERIENCE IS DONE ALREADY. WOULD THAT BE A PROBLEM IF I FILE MY PR???

Well... OK, so your employer has shorted you out of 2 paychecks, or 4 weeks of work. Personally, I'd find that a problem :) And I'd want to get that fixed before doing anything else.

According to your pay records, it will look like you work 36.92 hours per week instead of 40 ( (80*24)/52). So if you claim to work 40 hours per week, there will be a discrepancy, and yes, that could cause a problem.

Other than that, you will have to work longer than a year (by 1 week) to meet the required hours (according to the evidence of your pay records).

If working more time is the only case, then I don't mind. I will definitely go for an extra month.

I hope there wouldn't be any other issues.

Hi Manjot, why was cheque supposed to be on bi-weekly basis?

Hey Johnny123, I get my pay for 80 hrs on every 15nth n 30th of a month. If you count the number of days I worked in a month, the hours worked would be greater then the hours I got paid. And if we follow the total hours worked in a month as per our cheque which was made on semi-monthly basis, we get figure of 148 hrs; and we are supposed to work for 160 hrs a month (160hrs*12months=1920hrs or 1 year).

and if you follow bi-weekly, you get paid for exact time you worked.

See my first post, where I describe one inconsistency.

As well, if your letter of employment says you are supposed to be paid XX.XX an hour for a 40 hour work week, your annual salary will be will be calculated based on 52 weeks, not 48. So There's another inconsistency (including with the tax documents).

1. Under current rules, full-time is 37.5 hrs per week for CIC. So working 40 hrs, 60 hrs a week is still counted as 37.5 hrs.
2. There are 52 weeks in a year(12months)...at 37.5hrs per week, that gives 1950 hrs(37.5hrs*52 weeks), not 1920hrs.
3. On a bi-weekly schedule, there are 26 paydays in a year...you were not paid for 4 weeks of work. I don't know about you, but working over 40hrs a week(not being paid for the extra time) and still getting shorted 4 weeks of due pay, would not be acceptable to me.
4. Follow the lawyer's advice....if you don't now, you will have to when CIC begins asking questions or worse, they reject the application.

In the future, ask for your job offer letter in writing and understand it before signing. You have to look out for yourself too.

ok Im in trouble I guess :-\, and I was afraid some one was going to say start your 1 year experience from very beginning and correct your pay cheques :'(
