Passport stamping Advise..

Hello good people of this forum, i am a Nigerian applicant applying from London CIC office.
They have just requested for our passports (Me, my husband and 2 children) for Visa stamping which is very good to hear after waiting for 2 years. The problem I am having now is that, my husband does not have a visa (UK visa or any other visa, blank) in his passport. He came into the UK Illegally and have been living here for 4 years. But he managed to get a passport from the Nigerian High commission.

My question is, will the London CIC question why his passport is blank without a residential visa? and will this affect me.

That is a hard one here..I am applying from London CIC as well, they sound strict...But who knows, maybe they will not ask you for further proof for your husband. Wait for a more advise though, this is just my opinion.

Hmmmm a serious question....

is there any way out if you say that the passport is lost and you had reapplied for a new one or something... I guess this is a tough one..

Agreed, also if CIC gets any doubt they can check with UK immigration and easily find it out.

I would wait to hear from other senior members.

What did you fill for your husband in the immigration forms? I mean where did you say he lives, what status did you declare? Did you say he is in UK? If YES, the CHC would definitely raise eyebrows if you send a virgin passport without a U.K visa. What I mean, they actually asked in the form to declare if someone is having 'NO STATUS'. Have you declared that he has no status in the application form? If yes, then to the best of my knowledge, since you have told them the truth, they won't raise any eyebrow.
Did you say he is in Nigeria? If yes then they may report you for misrepresentation if they find out NOW or LATER that he has been living in the U.K.
It is always good to be truthful when dealing with immigration officers.
If you can answer the above questions to the best of your ability that is problem half solved as a lot of people may be in the same shoes as yours.
I honestly and genuinely wish you and your husband the very best of luck.

On the application form I filled in that he is here in the UK and I did not see any option to select 'NO STATUS' i would have selected this option if it is in the form. I seriously do not want this chance to be ruined. Has anyone heard of such case from other people before, please share with me how it turned out.

In Schedule1 background information form, Question 5 asks about 'Current country of Residence', Did you fill Nigeria or U.k for your husband? Question 6 asks about 'Your Status in that Country', Did you fill 'Non Status' for him? The guideline to completing the form actually gives an option to chose 'Non-status' if someone is illegal. I filled out these forms in july 2004, I still remember what I filled in, you only filled the forms about 2years ago so I assume you will still remember what you chose.
The truth of the matter is this, the CHC is very clever, even though they are so fair, they can always find out, it may not be now, sometimes it could take years. It could result in being removed from canada. That's why they always advise someone to be honest. They won't crucify anyone for being honest.

One thing that may interest you is this, because they have asked for your passport, you may think they have concluded your case, remember they still have all the files and information on their system. THEY MAY EVEN ISSUE THE VISAS but if they find out any kind of misrepresentation sooner or later, they don't take it lightly.

In the same background declaration form, last page, second point in the declaration section where your signature is required, the point clearly states that ' I understand that any false statements or concealment of a material fact may result in my exclusion from Canada and may be grounds for my prosecution or removal'. they know what they are doing.
If I were you, before you submit your passports, speak to an immigration lawyer, seek for legal advise.

For PCC in the UK, you can get one without asking for your immigration status. I remember they only asked for my photo/data page in my passport. Aww I feel sorry for this woman now..well, I hope this goes well for you...Being Illegal is not right but not all that bad as long as he has not crimes and offenses.

I don't think they take first page data of the passport for nothing. Illegal immigration is considered a serious offence.

it all depends on what you wrote for him in schedule 1. if you proved that he was in UK, then you must have sent them a full photocopy of passports and they did not find the UK visa... wonder why they did not check then. But, they sure will catch it now... illegal immigration is a serious offense and all your visas may be declined because of your husband's status in Uk...

if you mentioned Nigeria, there's a bright change of getting away with it... they will think he was always in Nigeria.. But, this is again misrepresentation and your PR can be cancelled if they realise this any time even after entering Canada. but, you may get away with it...

whatever the outcome, it's too late to plan anything.... you cannot do anything apart from sending the passports and praying...

Definitely they will catch it now if it’s mentioned UK in the form for the husband. Unlawful activity/offence falls under security check which is done after passport submission and before visa stamping.

I know the truth is bitter but I also know the truth is there to be told for those who care to listen. I am nobody to crucify this lady! Unfortunately, issues like this are not taken lightly by immigration officers. They would not even ask questions if you have declared your husband is illegal in the u.k provided he is not a criminal. Of course, it seems to me that he is not a criminal because they would have done some criminal checks but I also read in a forum that someone was removed from canada just few days before geing given his CITIZENSHIP because CHC discovered there was a misrepresentation during his PR application.
The beauty of this forum is that we are here to share experiences and not to judge anyone.
