Passport returned without visa issuance - London VO

Hello everyone,

I am new to this forum. Joined in to get some info about my case being processed at LVO.
My wife's sponsorship case is in a strange situation right now. We both live in US currently on TN and TD visas.

When i filed back in February 2013 I was in Canada so did not have any issues there. I moved to US in August 2013 on TN and my wife back then was still in Pakistan doing her final year of University. However, soon after getting done University i got her TD visa approved for the US and she moved just 4 months ago. Interestingly, the week she moved to US; LVO asked for re-med. We were unsure about how long she would stay in US so we refused updating her home Karachi address etc. We did re-med in US and soon after re-med we got passport request to send to Islamabad. Then, we informed LVO about her presence in US and showed intent to submit passport directly to LVO instead Islamabad since we cant really send passports in or out of Pakistan. That also worked out and LVO sent us new passport submission procedure directly to them in London.

we have provided all details about my current work in US and our temporary status. I was not expecting anything unusual since Canadian citizens can still sponsor spouse while being out of Canada. But unfortunately, they returned passport today without visa.

I have not heard any thing back from them about additional documents or reasons of not issuing visa.
Have any one had this kind of situation before? and what do I need to do this at this point of time? I am very clear that we will move to Canada once she gets her immigration visa.

If any one have had such experience please share. I would appreciate your help. We want to move to Canada but due to these issues we just dont know what to do at this point of time. And what kind of delay this can cause to the rest of file processing. Is it a sign of a rejection?

was there anything in the package WITH the passport about why it's being returned?

when you sent the passport, what was included in the package about why that passport was being sent to LVO? it could be they got the passport, had no idea why they got it, couldn't find the application (because it's not the visa office processing the application) and returned it.

I would recommend reaching out to the visa office handling the application and asking them how to ensure LVO initiates the visa.

Actually, LVO is the one processing the application. Initially, file was processed at ISLAMABAD but then they transferred to London for further processing.
As noted, first instruction LVO gave us to send passport to ISLAMABAD but upon our request LVO sent us new instruction to forward passport to London. We included that passport submission email with the passport. And passport was sent to LVO via VFS Canada VAC, London per LVO email.
I have reached out to them already to find out reasons. Even though, the email we received for passport submission clearly indicated that file is ready for visa issuance!

then I think the only thing to do at this point is to keep trying to contact the visa office, and if you know where you will be settling, find an mp in the area you plan to live and ask if they can help you inquire. generally, MPs who are helpful can get through to CIC quicker and get more information. cic must respond to their request within a certain amount of time.

Actually, I would say go t your MP right now. I waited until the almost last day, and the lady working there said - you could have come earlier, that is why we are here for. And she got more info on my file in 12h than I got in months.

Thanks. But would these MPs respond over the phone or something? I am in US right now so not sure how would they treat someone out of Canada.

Not sure. We called our MP yesterday, the lady working there was more than helpful. BUT we did need to go in there to sign the release of information. Maybe you can arrange with them to do that through fax or e-mail. I would certainly try, as VOs respond slowly to all inquiries/e-mails, even when urgent, and MPs get information way more quickly.

Just to make sure to let you know, not all MPs are helpful, so I hesitated with mine, and man was I wrong. It can't be bad to try, you lose nothing :D

I have made a contact and so far lady at the office does seem helpful or least not arrogant! I got one question though, do these MP offices can help in your case or all they do is bring you latest greatest updates about file that is all?
by help i mean, would they write anything on our behalf to CIC VO etc. etc.

Yes, they do. They can do an inquiry in the MP's name, and CIC is obliged to respond within a certain amount of time (I forgot what it was.) In our case, our VO did not respond to our emails but they responded to the MP in 12 to 24 hours.

Same with me (as Kayaker), I didn't get any responses to e-mails, and MP got response in 12h or so. And since there will be 30 days since our PPR on Friday, she will get us an extension if they don't find out passport soon.

I see. well i hope this MP I contacted in Markham area would be helpful and we can figure out the details of my file.

As a sponsor, if you are not a Canadian citizen you MUST remain in Canada until your wifes visa is stamped and she has landed. If you are a Canadian PR this would be why the passport was returned without a visa. You left Canada and moved to the US.

If you are a Canadian citizen, by moving to the US and taking a job there and then proceeding to get a visa to bring your wife there you are showing them you have no intentions of residing in Canada which would also trigger non issuance of her visa. I suspect she will get a letter outlining why her visa was not issued.
