I am facing almost the same problem.
I was on a student visa back in the US and for 1 semester i was full time punctual student. But some of my friend from my home country wanted to come to Canada and asked me to join them. I came with them even though i didnt know a lot about the consequences of what i was doing.
We all made the refugee claim at the Canadian port of entry and they seized our passports and other documents.
Now that i am here, i learnt a lot about what Refugee claim is and what a big mistake i did.
I wanted to go back to US, to do that I asked Canadian Immigration Office to hand me over my passport and other documents but they denied, telling me that "we would give you, your passport only if you withdraw your claim."
now i have two questions that no lawyer yet was able to answer.
What if i get a new passport from my home country embassy and apply for new US visa?
and Will the US embassy issue me new visa?

Guess what the mistake you made is even worse than you may have thought.

If you apply for a new document and a new visa for the US the fact that you already had a visa is recorded and questions are likely to be asked. How do you plan to explain that you do not have your passport with the original visa? A police report would usually be asked from your government representative if you say it was lost and the police have heard this so often that they may not give the report.

As you have been advised, if you wish to depart you need to withdraw your refugee claim and provide evidence that the withdrawal has been accepted by the refugee board to the CBSA. Then proof of a booking home needs to be presented to the CBSA office with your file. Give notivr of at least a week, better still 10 days before departure. It's important to arrange to leave before your departure order becomes a deportation order. You must confirm your departure from Canada through the CBSA or over time even if you depart on your own your removal order will become a deportation order and when you fail to show up for interviews a warrant for your arrest will be issued. That warrant can be seen outside Canada.

At this point you should consider the visa for the US as having been voided.

if any body want to enter Canada from USA then went to Bufallo in office of Viva inc(viva la kasa) you can also search its address on line.In this office one person officer of canadian is sitting there(in viva inc) actually he is Church and provide you access of living 70 doller per week .you pay 70 doller and you can live +eat 7 days service, and there your documents will checked by canadian officer and if you qulify hen officer will send your name for appointment on border of Canada, if officer send your name 99 percent your appointment will conformed, ad then in viva office you will received your appointment time and date on border. If you have blood relation or first cousin or real uncle real anti they lived in Canada and have citizenship then your appointment on ca border will conformed and you will reached in canada, but you shuld klaim refugee claimenet on the border. ok

This is a bit off topic, but I don't see why Canada would accept any refugee claimants who are already in the US. Obviously their lives aren't really in danger living in the States, and if they are true refugees, then the US can offer them asylum. These loopholes need to be closed before we are burdened with further taxes.
