Hello Friends,

I am back to the forum..after receiving PR recently for myself and my wife in March, 2015. Fortunately, my wife found a job in Montreal and she is currently working. I am still in the USA working on H1B. We are planning to apply for PR for my parents. I have a couple of questions:

1. Can I sponsor my parents' PR while I am residing in USA? Is there a waiting time before I can sponsor my parents?
2. Can my wife, who is currently working in Quebec, sponsor PR for my parents?
3. I don't think my parents have birth certificates, because they were born before 1960s, do they need affidavits? What are my options?

I really appreciate if anyone can answer my questions.

Thanks.

1. No - you can't. You must be living in Canada when you apply to sponsor them and must continue living in Canada while their application is being processed. There is no minimum wait time. However the combined incomes of yourself and your spouse must meet the low income cut off requirements to sponsor your parents for at least three years in a row before you appy - and that income must be from Canadian sources.
2. No. You must be the primary sponsor.
3. Not sure - hopefully someone else can help.

1. No, you must be residing in Canada to sponsor your parents, and must remain residing in Canada during entire processing right up until they get PR.

2. No, she can only sponsor her own parents. She can just be co-signer on your parent's application if you need her income to qualify. And for her own parents, she must be able to show 3 years of Canadian income meeting the LICO amount. So if she just arrived to Canada in Mar 2015 then it will be around 2019 or 2020 before either of you can even begin the process.
