I am Pakistani living in South Africa on Permanent Residence Visa with my family, my kids are South African Citizens.

Due xenophobia and racism in South Africa day by day we are getting effected, and life is always in danger when going out, living in fear even while on the road driving car, specially for foreigners, we flee Pakistan due to religion persecution.

1. Been hold on Gun point several times while walking on the roads and got robbed.
2. Our shops have been robbed so many times,my father got injured so many time.
3. Racial discrimination almost every where.
4. Hijacking.
5. Being threaten with gun by local taxi drivers on the roads.
6. Attempted kidnapping in Shopping mall.
7. Being witness of our neighbor shop keeper who got shot and died on the spot, and being threaten not to say anything.

we live in fear every day of life here :(

Since your citizenship is of Pakistan and not South Africa, did you try to return to that country and get residency and citizenship for your children there?

Hi Vensak,Thanks for your reply.
I went Pakistan in 2015 thought things will be different after 5 years,
no i didn't try to get residency and citizenship for my kids.

The thing is following. You do not have citizenship in South Africa in the first place (you have only mentioned residency visa). So the first logical question would be following:
1. did you file up the robbery and kidnaping attempts with the local police. And what was the result there.
2. Did you try to contact your embassy regarding help to the Pakistani citizen over there.
3. And of course did you try to move to Pakistan with your family?

Hi Vensak,thanks for your reply.
yes have reported to police, out come was not enough evidence to proceed with report.
Embassy will not help they straight tell you why you come to South Africa because south Africa is known for such things.
I did went to Pakistan to see if i can move back in 2015,we had issues again because of my wife whole family being flee to bangkok in 2014, due to religion persecution.

I think you will face the same challenges if you apply for refugee status in Canada. Most of the items on your list are unfortunately common occurrences in SA and probably won't be grounds for a refugee claim. These things happen to people born in SA all of the time - they aren't unique to you or your family.

For a refugee claim in Canada to succeed - you will have to prove that you cannot return to Pakistan AND also cannot return to SA. I think that's going to be pretty difficult. You'll have to provide strong proof of persecution in both countries.

If you want to try applying for refugee status all the same, you'll need to obtain a TRV and travel to Canada to make your claim.
