I arrived in canada 6 months ago as PR, and my wife came here 2 months ago. Now she wants a khula(means separation in marriage initiated by wife), if we make khula papers in pakistan will they be accepted here? or it has to be done in canadian court only?- Note we both applied for PR at one time so this is was not a family sponsorship.
I read a few post regarding this and found out that if a person has ties to the country where marriage was done for last 1 year then divoce from there is acceptable. Because she has not spent just 2 months here and rest of the months there from the last 1 year then it can be done there. She is also willing to voluntarily give up her permanent resident status, so there are a form which needs to be filled and sent to CIC.
I tried calling CIC to confirm this but they are no longer taking calls I believe.
