Hello all,
I have received ITA, and currently, I am looking at all the data which I have to enter. In my spouse details, they have asked whether she has been previously married?

Background: She was married before to her Canadian cousin, and although he had started spousal immigration, things went different and ended at divorce. she never went to Canada, and she never lived with him (rukhsati not done).

Should I say ''YES'' to this question? will they ask previous marriage certificate, divorce certificate etc?

Thank you.

If she was married before, then you need to answer "yes". If you don't, you will be committing misrepresentation. This is even more important since you're saying that her former husband started spousal sponsorship, so the Canadian government knows that she was married to someone else.

I don't know much of Islamic law/custom, but if there was a legal marriage ceremony, then she was indeed married. And since you're saying that the marriage ended in divorce, there obviously was a marriage - otherwise there couldn't be a divorce.

You will have to provide any documents if they ask for it. I think they will ask for the divorce certificate to ensure that your marriage to her is legal in Canada. Just make sure you don't say she wasn't married since that will cause major issues with your application.

Hi 21GOOSE, thanks for your valuable response. I have received the same reply from many other fellow members as well. That, I should not hide anything from them, especially if the spousal immigration was initiated before. Since they would have it in their database as well. Thank you once again for detail reply.
