Hi everyone,

I was wondering if you could help me. We applied for my spouses open work permit online July 18th. We are worried that it won`t be processed in time. Any one have any advice on this. What happens if it hasn`t been processed by then, is there any kind of bridging visa they offer.

Also, someone told us that we can drive to the US for a few days Vacation and then apply for it at Port of Entry when were returning into Canada, anyone heard of this before?

She is on implied status until she gets the new permit.


As per CIC website:

Implied status

If your visitor visa expires after you have submitted your application for an extension of your authorization to remain in Canada, you will be considered in status as a temporary resident (visitor) until a decision is made on the application. This is known as implied status.

Does implied status mean she can still work until the decision is made also?

Hi, your very welcome.
All I am sure of is that if she has a closed work permit she can keep working for the same employer if she applied for an extension.
Or if on visitor permit will have applied status as visitor.

I think because she is applying for a different kind of work permit she will be on implied status as a visitor. So must stop working when the permit expires. She may just have to take some days off. and come back to work when the permit is there.
Which would not be too bad because the current processing time is only a month and you are almost there. I'm sure it will be there soon.

Yes. You can stay in Canada, and may be able to keep working, under what's called implied status. That means the law implies you are a temporary resident. The implied status lasts until Citizenship and Immigration Canada (CIC) decides on your new permit application. However, you must respect the following requirements:

If you applied for another work permit

You must stay in Canada and meet the conditions of your original work permit. If you applied for a work permit extension before your work permit expired, you can keep working under the same conditions as your existing permit until CIC decides on your application unless you have applied to extend your stay under another category.

If you applied for a different kind of permit

You cannot do any of the activities allowed by the original work permit. For example, you may have come to Canada as a worker and then applied for a study permit. If so, you must stop working once your work permit expires. After that, you cannot work or study until you get a new permit.
