Overstayed on my last visa. Will I get visitor VISA? Spouse is Canadian

Hello, I overstayed on my last visit to Canada. While in Canada, I got married to a Canadian citizen. My status had expired and we were planning to apply for my PR based on spousal sponsorship. But I had to leave Canada because my father was ill. I am now planning to return to Canada. Can I be issued a visitor VISA if my spouse is Canadian? I can prove that my spouse will be sponsoring me. Also, does having a job offer help? (in which case I can apply for a close work permit and a work visa?)

Or is my only option applying for a PR from my country? (My home country is a non visa exempt country) If this is my only option, how long will it take? Is there any way for me to come to Canada and then apply for PR?

Hi

Given the overstay and your Canadian spouse, the possibility of being granted a TRV is very low.

A job offer counts for nothing unless the employer has an LMIA.

You should be applying outland now. As I said above, there is little chance of you being able to come to Canada before becoming a PR.

Thanks for your response! I presume an employer with an LMIA is hard to come by.

But would my PR application be accepted even though I overstayed? And approximately how long would my PR application take to process? Thanks so much!

Yes, an employer willing to go through the LMIA process is very hard to come by.

Yes, your PR app will be accepted. Without knowing where you are from, I can't say how long it will take.
